This is a legal and binding agreement between you, the user ("User" or "You") of the Services, as defined below, and Novi Digital Entertainment Private Limited (formerly known as Indya Interactive Services Private Limited) stating the terms that govern Your use of the Site (as defined below). BY ACCEPTING THESE TERMS OF USE IN ANY MANNER OR ACCESSING THIS WEBSITE, YOU CONSENT, AGREE AND UNDERTAKE TO ABIDE, BE BOUND BY AND ADHERE TO THE TERMS OF USE and the Privacy Policy accessible at www.hotstar.com/terms-of-use and www.hotstar.com/privacy-policy respectively and any other terms which govern the Site (together referred to as "Terms of Use" or "Terms" or "Terms and Conditions") AND IF YOU DO NOT AGREE TO THESE TERMS OF USE, YOU ARE NOT ENTITLED TO AVAIL OF / USE THE SERVICES AND ANY USE THEREAFTER SHALL BE UNAUTHORIZED.

Description of Service and Acceptance of Terms of Use

Novi Digital Entertainment Private Limited (formerly known as Indya Interactive Services Private Limited) is a company incorporated under the Companies Act, 1956, having its registered office at STAR House, Urmi Estate, 95 Ganpatrao Kadam Marg, Lower Parel (West), Mumbai- 400013, India ("Novi").

Novi inter alia provides an online website 'www.hotstar.com' as an interactive platform for its viewers and any associated mobile sites, applications ("Site") to inter alia view serials and programs, films, sports content including live sports content, trailers of upcoming serials, view videos and/or photos of their favorite characters on serials, read recaps of serials, international content including viewing schedules of content offered etc. on the Site and any other features, tools, applications, materials, or other services offered from time to time by Novi in connection with its business, provided on the Site ("Novi Content") and includes posting of comments, participation in contests. The Site may also provides you content by integrating services and application of other audio video streaming platforms ("Partner Content") and/or provide hosting service to third parties to display their content ("Third Party Content") (all such features of the Site collectively referred to as "Services"). 'Content' will hence consist of 'Novi Content' and 'Third Party Content'. Currently Novi provides Partner Content from HOOQ and it may continue to include such additional Partner Content from other parties, from time to time. Specifically, for more information in relation to Partner Content of HOOQ (including the terms of use relating specifically to HOOQ service), you may refer to the following URL :- https://www.hooq.tv/terms-of-use .

Novi Content and the Partner Content will be made available to You through different modes, at the discretion of Novi, including via video on demand basis for viewing at the User's discretion at a time chosen by You and download for offline viewing by You. Please note that the availability of, and Your ability to access, the Content or some part of Services, (a) is subject to Novi's sole discretion and (b) may be dependent upon Your geographical location and (c) is on the condition that not all Content or Services will be available to all viewers. On account of the nature of the Internet, this Site and the Services may also be accessed in various geographical locations; and You hereby agree and acknowledge that You are accessing this Site and availing of the Services, at Your own risk, choice and initiative and You agree and undertake to ensure that Your use of the Site and the Services complies with all applicable laws including the local laws in Your jurisdiction. Further, such Services and Content may vary from place to place, time to time and device to device and would be subject to various parameters such as specifications, device, Internet availability and speed, bandwidth, etc. You agree and acknowledge that Novi may monitor or use certain technologies for monitoring of activities including logging of Your IP address to ascertain and verify Your geographical location. To facilitate Your viewership and access, the Services can be packaged by Novi through different models such as, Content or Services may be accessible (a) free of charge which may include advertisements or commercials or (b) via subscription through payment of a subscription fee or (c) a pay-per-view model with or without advertisements/commercials or (d) with a combination of the foregoing on the Site.

The Service can be availed through platforms, software and devices, which Novi approves from time to time, the current list for which is as set out below ("Compatible System"). In some cases, whether a device is (or remains) a Compatible System may depend on software or platform provided or maintained by the device manufacturer or other third parties. As a result, devices that are Compatible System at one time may cease to be Compatible System in the future.

Subject to compatibility, You may be able to access the Services through mobile phones, tablets and other IP based connected devices or any Compatible System offered by a partner authorized by Novi ("Partner").

Use of the Services is subject to compliance with these Terms of Use.

Unless otherwise specified, the Services is available for individuals who have attained the age of majority in their jurisdiction; in the case of India, this service is restricted to Users who are  aged 18 years or older. If You are under the relevant age of majority in Your jurisdiction, You may only access the Site and the Services only in accordance with applicable law which enables a minor in your jurisdiction to access such a service.

SOME CONTENT OFFERED ON THE SITE MAY NOT BE SUITABLE FOR SOME VIEWERS AND THEREFORE VIEWER DISCRETION IS ADVISED. ALSO, SOME CONTENT OFFERED ON THE SITE MAY NOT BE APPROPRIATE FOR VIEWERSHIP BY CHILDREN. PARENTS AND/OR LEGAL GUARDIANS ARE ADVISED TO EXERCISE DISCRETION BEFORE ALLOWING THEIR CHILDREN AND/OR WARDS TO ACCESS CONTENT ON THIS WEBSITE. Your access to and use of the Services is subject to these Terms and Conditions, Privacy Policy and all applicable laws, rules, and regulations.

Participation in any contest and or game on the Site conducted by Novi or viewing of certain Content may be subject to further terms and conditions as may be notified by Novi from time to time on the Site or otherwise.

Electronic Communications

When You use / avail the Services or send any data, information or communication to Novi, You agree and understand that You are communicating with Novi through electronic media/ records and You consent to receive communications via electronic records from Novi periodically and as and when required. Novi will communicate with You by email or any push or other message or electronic records on the email address and or mobile number available with Novi or made available to Novi through a Partner which will be deemed adequate service of notice / electronic record.

You acknowledge that specifically consent to Novi or our respective affiliates and partners contacting you using the contact information you have provided to us at any time during your association with us for any purpose including the following purposes:

You acknowledge and agree that you may be contacted for the above purposes, using any of the contact details provided by You, including via emails, text messages or phone calls.

In the event You have indicated any 'do not disturb' preferences to Your telecom service provider, and registered Yourself on the national customer preference register / 'do not disturb' or similar list, We request You to ensure that Your registered preferences allow for communications to be sent to You in accordance with the above provisions.

The Content contained in the Services including but not limited to on the Site is protected by copyright, trademark, patent, trade secret and other laws, and shall not be used except as provided in these Terms and Conditions, without the written permission of Novi.

KEY RULES & REGULATIONS GOVERNING PARTICIPATION IN WATCH 'N PLAY

  1. The Watch 'N Play game or Game Play is available only in English and in portrait mode of the Hotstar app.
  2. Existing Hotstar users must upgrade their app from the App store or Play Store to participate.
  3. New users can access the Game by downloading the Hotstar App from the App store or Play Store.
  4. Although the Participant can participate in the Game play without registering, he/she will be able to redeem the vouchers and grand prizes only post registration.
  5. The participant can register through his/her email ID or can log in through his/her Facebook account.
  6. Watch 'N Play will require the participants to answer two types of questions:
    • Trivia Questions with three answer options which will test the participant's general knowledge about cricket. These questions may also involve questions related to the sponsors of the Game Play.
    • Contextual questions with three answer options
  7. For contextual questions, the final outcome in terms of total runs scored by the team on any given ball would be considered as the right outcome of contextual questions, except in cases where the final outcome has resulted in the loss of a wicket.
  8. For matches held from 15 September to 21 September 2018:

  9. The scores associated with each correct answer for Trivia Questions shall be either 100 points or 1000 points. The points allocated to each question shall be done at the discretion of the Company.

  12. The scores associated with each correct answer for Trivia Questions shall be either 200 points or 1000 points. The points allocated to each question shall be done at the discretion of the Company.

  14. The device through which the participant plays or registers shall be the unique identifier for that respective Participant. The scores are not transferable between devices or log in IDs.
  15. The Game can be best experienced when the Hotstar App notifications have been turned on.
  16. All Participants are advised to remain in areas with strong and stable/continuous mobile network signal of the telecom operator or internet service provider to ensure smooth functioning of the Game Play.
  17. All registered Participants are eligible to win the following types of Prizes:
    • Level Wise Offer Prizes – Participants can win Voucher Prizes achieving the pre-defined Scoring Levels by scoring the cumulative total points assigned to each Scoring Level.
    • Match Prizes – Participants will be eligible to win the Match Prizes basis the total cumulative points scored at the end of the Match
  18. Fulfilment of all Match Prizes will be subject to verification of Participant details, collection of documents and payment of applicable taxes, if any.
  19. A Participant who has won a Prize in a Match will not be eligible from winning the same Prize for subsequent Matches.
  20. We recommend the Participant to address all queries regarding the fulfilment of Match Prizes to the following:

  21. The following factors will have a bearing, in this order of priority, while determining the ranking of Participants who are eligible to be Match Winners:

    • The cumulative points scored by the Participant;
    • Lexical order of the Participant's Device ID, relative to other participants that have the same cumulative score, to be used in the event of a tie-breaker

  22. Announcements for winners for all types of Prizes are subject to an independent third party validation.
  23. Announcement of winners shall be made by means of in-app notifications to the winner
  24. Only registered winners will be eligible for Prize Fulfilment subject to successful verification of the identity and eligibility documents furnished by the winner.
  25. Decisions made by the Company shall be final and the Company shall not be responsible for loss of data/points or any other advantage/disadvantage caused to Participants due to technical errors or issues in their device, application, internet connection and/or network coverage.
  26. We would recommend the Participants to maintain privacy of his/her personal details and not mention the phone number or any other personal details on any social media platform.
  27. In case of any queries, please write to hello@hotstar.com setting out your concerns/issues. All endeavors shall be made to reply to the queries within reasonable time. However, the absence of a reply shall not be deemed to mean acceptance of any claims made in the query.

RULES & REGULATIONS GOVERNING PARTICIPATION IN
WATCH 'N PLAY

  1. CONTEST DESCRIPTION:

    "Watch 'N Play" is a skill based online game ('the Game') which is being hosted and can be played on the Hotstar Application which is owned and operated by Novi Digital Entertainment Private Limited. The Game is meant to test the Participant's knowledge of cricket, and the Participant's ability to gauge tactics, situations, forms, strategies, and performance.

  2. DEFINITIONS:

    • 1. For the purposes of the Rules & Regulations, the expressions used herein shall have the meaning ascribed to them as below:

      • a. "Airtel subscriber" or "Airtel Participant" is a subscriber of telecom services provided by Bharti Airtel Limited
      • b. "Company" or "NDEPL" means Novi Digital Entertainment Private Limited;
      • c. "Device(s)" shall mean mobile phones running the Android (with version 4.0 and above)/iOS (with version 9.0 and above) operating platforms, capable of receiving and transmitting data including via Internet and/or mobile communications technology and/or any other similar technology. The Game Play may work on tablets and devices other than smartphones operating on the android (version 4.0 and above) and iOS (version 9.0 and above) operating platforms, however, we recommend the Participant to play the Game on smartphones for a better user experience;
      • d. "Hotstar Application" or "Hotstar App" means the audio-visual streaming platform currently branded as "Hotstar" and accessible from the Device(s);
      • e. "Hotstar User(s)" shall mean any person who accesses the content on the Hotstar App
      • f. "Jio subscriber" or "Jio Participant", is a subscriber of telecom services provided by Reliance Jio Infocomm Limited.
      • g. "Match(es)" means a professional game of One Day International ("ODI") cricket match played between teams representing the Asian Cricket Council (Afghanistan, Bangladesh, Hong Kong, India, Pakistan and Sri Lanka).
      • h. "Match Leaderboard" is a dashboard which will contain details of points earned by all the Participants playing the on-going Match
      • i. "Match Prize(s)" or "Mega Prize(s)" means the prize(s) that may be awarded to a Match Winner(s).
      • j. "Match Winner(s)" refers to the Participants who have scored the highest points in the Game for every Match and are eligible to receive the Match Prize and are declared as a Match Winner basis their ranking, subject to conditions defined in the Rules and Regulations. Winners may be communicated of their winnings by the Company post completion of every Match
      • k. "Partner" or "Sponsor" refers to the organization(s) which are sponsoring the Voucher Prizes and/or Match Prizes
      • l. "Premium Subscriber" is a Registered User whohas availed the paid subscription or the sports pack on the Hotstar App to enable viewing of content on the App.
      • m. "Prize(s)" shall mean all Voucher Prize(s), Match Prize(s), and any other prize(s) or offers or coupons that a Winner may be eligible to receive, as may be determined and announced by the Company in terms of these Rules and Regulations.
      • n. "Registered User(s)" means a person who registers on the Hotstar App through an e-mail ID of Facebook ID to access and / or play the Game Play.
      • o. "Rules & Regulations" means these rules and regulations governing the Game, as stated herein in entirety and as may be amended by the Company from time to time;
      • p. "Score(s)" or "Point(s)" means the points earned and the score achieved by a Participant while playing the Game.
      • q. "Scoring Level(s)" means the different levels categorized to be eligible for different types of Prizes and the points that a Participant has to score to qualify for each level.
      • r. "Season" means the entire season of Asia Cup2018 consisting of approximately 13 ODI matches played between 15 September 2018 and 28 September 2018
      • s. "Social Leaderboard" is a dashboard which will contain details of points earned by all the Facebook friends of the Participant playing the Game.
      • t. "Stipulated Time" for the purposes of the Game shall mean either (i) the period until which the Company permits a Participant to answer any question forming part of the Game; or (ii) the time taken by the Participant to answer the question, whichever is lower, subject to a maximum of 10 seconds.
      • u. "Voucher Winner(s)" means such Participants who have unlocked vouchers by clearing the defined Scoring Levels and are eligible for Voucher Prize(s).
      • v. "Voucher Prize(s)" means discount or complimentary coupons from sponsors made available to participants who are eligible to be Voucher Winner(s).
      • w. "Watch 'N Play" or "the Game" or "Game Play" means the online game titled "Watch 'N Play" available on the Hotstar App which may be played by the Participants on the Device(s) in accordance with the Rules & Regulations;
      • x. "Watch 'N Play Participant(s)" or "Participant(s)" means any person(s) playing the Game on the Hotstar App and who (i) present in India (ii) is of sound mind and health and (iii) agrees to enter into and participate in the Game in accordance with the Rules & Regulations as defined in this document.
      • y. "Winners" shall mean all Voucher Winners, Match Winners, Season Winners or any other winners as may be determined and announced by the Company in terms of these Rules & Regulations.

  3. PROCEDURE TO PARTICIPATE IN THE GAME:

    • 1. Eligibility & Participation
      • 1. The Watch 'N Play is made available in English exclusively on the standalone Hotstar App of the Company as accessible on the Devices.
      • 2. Existing Hotstar users who wish to participate need to upgrade the Hotstar App in order to access the Game Play. New Hotstar users can access the Watch 'N Play by downloading the Hotstar App from the Play store / App Store.
      • 3. The Game Play will work on Android (version 4.0 and onwards) and iOS (version 9.0 onwards) smartphones only. The Game Play may work on tablets and devices other than smartphones operating on the android (version 4.0 onwards) and iOS (version 9.0 onwards) operating platforms, however, we recommend the Participant to play the Game on smartphones for better user experience. The Participant is required to check compatibility on his/her device before the Game Play. The Participant should access the Game Play from another device in the event the Game Play does not work on a device.
      • 4. The Game Play may work only in the territory of India and shall not be accessible from other territory (ies) across the world.
      • 5. To participate in the Game Play, the Hotstar user should be (i) present in India (ii) of sound mind and health and (iii) agree to enter into and participate in the Game in accordance with the Rules & Regulations as defined in this document.
      • 6.In case the Participant is below the age of 18 years, the Parent and / or Guardian of the Participant consent to his/her participation in the Game and agree with the Rules and Regulations of the Game and undertake to abide by all the terms and conditions contained herein.

    • 2. Registration
      • 1. The Hotstar Terms of Use available at http://www.hotstar.com/terms-of-use shall apply in relation to the Participant's registration on the Hotstar App.
      • 2. By registering through Facebook, the Hotstar User allows the Company access the information available in the Participant's Facebook account. The Participant can change this by changing the privacy settings for his/her Facebook account.
      • 3. The Hotstar User shall have to agree to the Rules and Regulations governing the Game Play prior to proceeding.
      • 4. All Hotstar Users that participate in the Game Play shall be deemed to have accepted all the Rules and Regulations as defined herein and updated from time to time.
      • 5. The Users can view the live streaming of the match and access the Game Play as per the below grid:

        * The Jio/Airtel sim should be used as the primary sim on the device for the Participant to continue with the live video stream

        ** 10 cumulative minutes will be calculated for the whole Season (and not per Match) and from the time the user first starts live streaming the Asia Cup 2018 Match after downloading/upgrading the Hotstar App. Please note that pausing the live stream will not impact the timer for calculation of the free 10 minutes

      • 6. The Game is available to all Hotstar Users, and is accessible for viewing and/or playing, for the duration of the live broadcast of the Match (on any medium), including the pre-Match and post-Match presentations and programming. However, in order to view and/or redeem the Prizes won by a Hotstar User who is Participant, the Hotstar User will have to become a Registered User. Upon becoming a Registered User, the Prizes won by a Hotstar User will be displayed in the "My Prizes" section of the Hotstar App.
      • 7. The Device through which the Participant plays the Game shall be the unique identifier for the respective Participant, irrespective of whether the Participant is a Registered User or an un-registered user or a Premium Subscriber of the Hotstar App. We urge the Participants to use Email or Facebook IDs where they would be clearly identified as the Participant of the Watch 'N Play.
      • 8. The Game points shall always accrue to the Device ID that a Participant has used to play the Game Play, irrespective of the e-mail ID / Facebook ID that the user has used on the said Device.
      • 9. If a device has been accumulating points as an unregistered user, whoever signs in first on a device, will receive the points accumulated till then on that device. If another registered user subsequently signs in to the Hotstar App to play the game, the points and Prizes of the previous user(s) may be added to the device ID and thus, will reflect on the subsequent ID used to sign in to the device. Points, Rewards, Prizes will be mapped to the device and not email IDs.
      • 10. Points shall not be transferable between any two devices and points do not accrue to the ID used by a Hotstar User to register on the Device. Registration is encouraged for the purposes of redeeming Prizes, but is not required to play the Game.
      • 11. In case of loss of Participant Scores due to loss of phone, data loss, login / logout issues or any other technical glitches, the Company shall not be responsible to identify the actual Participant who has played the Game Play and no questions / queries or requests in this regard shall be entertained. The Company's decision on whether the Participant should be credited unclaimed points shall be final and binding on all Users that participate in the Game Play. In case the Company identifies any malpractice/ fraudulent usage / unfair advantage to any User / Participant, the Company may disqualify the Participant without any prior notice/intimation.
      • 12. The Participant will not be able to answer the questions displayed on the Hotstar App while he/she registers or subscribes on the Hotstar app.
      • 13. Registering on the App does not entitle the Participant to win any prize.
      • 14. The Participant may be notified by any form of in app messaging and/or a pop-up and/or a display, requesting them to become a registered user of the Game, so as to be able to redeem Prizes.

    • 3. Charges for Watch 'N Play

      • 1. Please note that the Hotstar App download is free of cost, however, the viewing of the Match, live or otherwise, along with access and play of the Game Play shall use data. Therefore, the use of the Hotstar App and the Game Play will result in the use and consumption of data for which data charges as charged by your internet / telecom operator may apply. For further details, please contact your internet / telecom operator.
      • 2. Please check with the internet / telecom operator for any other applicable charges. In case any Participant uses the Hotstar App or plays the Game Play while roaming in a different circle/zone, additional roaming rates may apply. Please contact your internet / telecom operator for the applicable rates.
      • 3. Company will not and does not receive any monies and/or consideration from the internet / telecom operators and/or any third party, in connection with the data consumed by the Participant for the Game Play

    • 4. WATCH 'N PLAY

        • 2. The continued live access to the above mentioned schedule on Hotstar App is available to premium subscribers only.
        • 3. Matches forming a part of the above mentioned schedule could be modified or cancelled based on programming, technical requirements, unfavorable climatic conditions or any other reasons as the event organizer or the Company may deem fit. The play along in such circumstances may be rescheduled, extended, cancelled or terminated in entirety earlier than the said schedule
      • 2. Game Format
        • 1. Watch 'N Play shall require the Participant(s) to answer 2 types of questions:

          a. Trivia Questions

          • i. Trivia Questions are based on the general knowledge about cricket. These questions may also involve questions related to the sponsors of the Game Play. ("Trivia Questions")
          • ii. An example of a Format of Trivia Questions, could be - 'What is the full form of D/L method?'
          • iii. Each Trivia Question will have 3 (three) answers options to choose from.
          • iv. The points associated with each trivia question will be indicated next to the question

          b. Contextual Questions

          • i. Contextual Questions are based on testing the Participant’s knowledge about cricket and ability to gauge tactics, situations, forms, strategies, and performance. ("Contextual Questions")
          • ii. Contextual Questions, will be in the form of, 'What will be the outcome of the next ball?'
          • iii. The final outcome in terms of total runs scored by the team on any given ball would be considered as the right outcome of contextual questions, except in cases where the final outcome has resulted in the loss of a wicket.
          • iv. The answers to the contextual questions have been categorized into three categories as mentioned below:

        • 2.The Company reserves the right to add morescenarios, and also take appropriate action in case of any scenarios which do not qualify in the table above.
        • 3. The order and frequency in which each type of Question may be asked is at the sole discretion of the Company.
        • 4. During each Match the Participant will have to provide answers for each Question within the stipulated answer time, from the time the question appears on the Participant's Device. The Participant will win points as per the 'Scoring' process (detailed in section III) and be eligible to be included in the Match and Social Leaderboard on submitting the correct answer.
        • 5. The Company may increase and/or reduce the stipulated answer time to answer each Question at its sole discretion and the decision of the Company in this regard, will be final and binding on the Participant(s).
        • 6. Once the Participant selects a particular option/answer for the question presented during the Game Play, the Participant will not be allowed to change the option/answer. If for any technical and/or non-technical reasons, the Company's servers fail to register any option/answer provided and/or selected by the Participant, the Company, shall not be responsible for such delayed receipt or non-receipt or incomplete receipt or receipt of corrupted answers.
        • 7. The Participant may be notified by any form of in app messaging and/or a pop-up and/or a display, upon the receipt of the correct and/or incorrect answers. Only those options/answers which are received within the Stipulated Time, will be considered valid.
        • 8. In the event the Participant's responses to any of the questions during the Game Play, is not received within the Stipulated Time due to any unforeseen reasons or errors including but not limited to technical or network errors or glitches, the Participant will not be allotted any points for answering the question, notwithstanding the fact that the Participant may have correctly answered the question through the Device.
        • 9. In case multiple answer entries are received from Participant(s) for the same question, due to any unforeseen reasons or errors including but not limited to technical or network errors or glitches, the Company may at its sole discretion, choose the answer received at the first and foremost attempt by the Participant as recorded in the Company's servers.
        • 10. The Company reserves the right to revise the points earned by each Participant and update the, Match and Social Leaderboards with the revised points in case the actual outcome of the ball is different from the answer of the question displayed on the Hotstar App during the Game Play.
        • 11. The Company also reserves the right to suspend all Leaderboards at its sole discretion.
        • 12. The Company will not entertain any claims/questions/queries with respect to the authenticity and/or correctness of any questions and answers for these questions asked during any of the Matches.
        • 13. The Company's decision on the correctness or incorrectness is final and binding on all Contestants.
      • 3. Scoring

        For matches held from 15 September to 21 September 2018:

        • 1. The Participant(s) may win points as per the below table, as provided for within the Hotstar App for every correct answer of a Contextual Question and/or a Trivia Question:

        • 3. No points will be lost on incorrect answers.
        • 4. Participant points that are available and logged with the Company on the Company's servers shall be final and binding on all Participants. Mismatches between the points on the Company's servers and Participant's Devices could be for reasons such as (but not limited to) technology limitations, internet data breakdown, and disconnection of data link. Company shall not be liable to the Participants in any manner for such mismatches.
        • 5. In the event where the actual outcome of the ball is different from the answer displayed on the Participant's device, the relevant points will be granted to Participants who have selected either of answer options
        • 6. Uninstalling/reinstalling the App may lead to loss of points. The Company shall not be responsible for any such loss. The Company shall not entertain any claims for any such loss.
      • 4. Winner determination and Prize Fulfilment

        1. Participants will be awarded the following two types of prizes at different junctures:

          • i. The Company may decide to change the offers relevant to the Scoring Levels at any given time.
          • ii. In the event any Prize has to be suspended or becomes unavailable due to any reason, including but not limited to technical issues, force majeure, fraud, hacking, etc. the Company reserves the right to revise the Scoring Levels and the Prizes at its sole discretion. The Company may decide to add/modify Prizes at any given time. The Participant shall not be permitted to question or challenge any such revision by the Company.
          • iii. On clearing each Scoring Level by achieving cumulative target points, the Participant is eligible to win a Voucher Prize. The Participants that have reached / crossed the indicative Scoring Levels shall be notified regarding their Voucher Prize at the end of the over in which the Voucher Prize has been won.
          • iv. Prizes are visible, and can be redeemed, only after registration, from the "My Prizes" tab of the Hotstar App.
          • v. On registering, the respective voucher codes for redeeming the Voucher Prizes shall be credited to and visible in the "My Prizes" tab of the Participant's Hotstar application.
          • vi. The "My Prizes" tab will be visible on the Hotstar App till 15 October 2018.
          • vii. We recommend the Participant to contact the Partner as per the details mentioned in tables 1.a. and 1.b. for any complaints, queries or clarifications regarding the Voucher Prizes and Match Prizes.
          • viii. The terms and conditions for all prizes will be displayed in the menu tab on the Hotstar app

        2. A Match and Social Leaderboard for the Game Play will be maintained for each Match highlighting the ranks and scores of all the Participants during the Match. The Leaderboards will be accessible and visible along with the Game, and not otherwise. Due to technical factors suchas time lags, volume of traffic etc., the Leaderboards may not be a true reflection of the Participant's actual real-time score. The Company reserves the right to decide the periodicity of the updates to the Leaderboards, and the number of participants whose ranks and scores will get reflected therein. Mere inclusion of a participant in the leaderboard does not entitle the participant to a prize.

        3. The following factors will have a bearing, in this order of priority, while determining the ranking of Participants who are eligible to be Match Winners:

        • The cumulative points scored by the Participant;
        • Lexical order of the Participant's Device ID, relative to other participants that have the same cumulative score, to be used in the event of a tie-breaker

        4. The Company will not permit or entertain any requests or claims to check / audit / challenge the logic of the factors relevant for determining rankings

        5. A Participant who has won a prize in a particular category in the previous matches will not be eligible for winning a prize for the same category for the subsequent matches. In such a situation, the Participant will become eligible to win a prize in the next lower category as per clause 4.1.b. In the event the participant has become eligible to win a prize in the last category, and the participant has already previously won a prize in the last category, such participant will not be entitled to receive any prize.

        6. In case of Match washouts or suspensions for any reason, the winner determination process will be conducted only if a minimum of one over of the Match was played between the two teams.

        7. The Participant shall be informed about the result of him/her winning the Match Prizes by means of in-app notifications and/or call attempts at the India mobile number provided by the Participant

        8. In case the Participant has been shortlisted as eligible to receive the Match Prize, a unique coupon code will be sent to / received by the Participant, along with a form requiring him/her to fill in his/her ten digit mobile number. The coupon code will be unique to every specific device. The Company will not be liable to issue multiple coupon codes to any participant under any circumstances whatsoever.

        9. It is the sole responsibility of the Participant to maintain the secrecy of code and to ensure that the same is not leaked or shared with any other person.

        10. The Company will not be liable to award any Prizes to a Participant who does not have a valid coupon code.

        11. The coupon code will need to be presented at every juncture of the Prize fulfillment process.

        12. By agreeing to the Rules and Regulations the Participant agrees to be contacted at the number provided by him for purposes, including but not limited to, collection of basic KYC details, communication and acceptance of taxes to be paid the Participant, collection of KYC documents and such other details as may be deemed necessary by the Hotstar team.

        13. The Company will carry out KYC of the Participant and all prize fulfillment and offer redemption will be fulfilled by the Partner or the Prize Sponsor.

        14. Upon being notified as a Match Prize Winner, The Participant will be contacted within 15 business days of entering the mobile number on the Hotstar App, between 9 am to 9 pm.

        15. The Match Winner will be required to enter an Indian mobile number only. The Company will not contact the Match Winner on any number other than an Indian mobile number.

        16. The Participant will be responsible for providing the correct mobile phone number to the Company and Company will not responsible to validate correctness of the mobile number provided by the Participant.

        17. The tele executives will make three call attempts to the Match Winners

        18. In case where the Participant was not reachable after repeated call attempts, the Prize will be forfeited.

        19. The Participant understands and undertakes that for him/her to be able to claim the Match Prizes, it is his/her responsibility to pay all the direct taxes and other ancillary charges (gift tax, income tax, etc.) to the relevant authorities and furnish the relevant challans to the Company and/or the Prize Sponsor to enable fulfillment of the relevant Prizes.

        20. To facilitate the Prize fulfilment process, the Company has the right, at any time, to require proof of identity and/or eligibility from the Participant(s). Upon request from the Company, the Participant may be required to furnish necessary supporting documentation, including but not limited to proof of age, address, name, photo identity and nationality

        21. In case a Match Winner is below 18 years of age, his/her guardian is eligible to claim the prizes on his behalf and shall be liable to pay all the direct taxes (gift tax, income tax, etc.) to the relevant authorities and may be required to furnish necessary supporting documentation as proof of relationship, age, address, name, photo identity and nationality to enable fulfilment of the Prizes.

        22. The Company may, at its discretion, contact the Participant(s), if required, for any clarifications needed regarding the information provided by such Participant(s).

        23. Failure to provide any proof or requested information, within the timelines as may be communicated by the Company and/or the Partners to the Participant(s), could result in the Prize being forfeited.

        24. The Company also reserves the right to forfeit the Prize in case where a discrepancy is found to exist in the information furnished/provided by the winning Participant.

        25. As a platform Novi is only organizing the Game and identifying the Winners of the Game Play on the basis of the Rules and Regulation as set out herein. All Prizes are sponsored by the respective Prize Sponsors. The Prize Sponsors shall be responsible for the guarantee/warranty and/or the validity of the Prize. Please refer the terms and conditions of each Prize Sponsor for more information in this regard.

        26. The mode of delivery of the Match Prize will be at the discretion of the Company and the Prize Sponsor. For Prizes for which the delivery needs to be made by the Company and by the Prize Sponsor, the same will be delivered at an Indian address only.

        27. By accepting the Rules and Regulations, the participant thereby agrees to comply with the mode of delivery of Prizes chosen by the Company and/or by the Prize Sponsor

        28. All personal details and information requested by and submitted to the Company by each Participant must be truthful, accurate and in no way misleading. The Company reserves the right to disqualify any Participant(s) from the Game, at its sole discretion, should the Participant(s) at any stage submit false, inaccurate or misleading personal details and/or information.

        29. Inability of the winner to claim the Prize within the defined timelines will entitle the Company to forfeit the prize. The Company will contact the Match Winners at each of the following junctures:

        30. Whilst the Company shall make all reasonable endeavors to contact all Participants at each relevant juncture of the Prize fulfilment process, the Company can make no guarantee of the receipt of the attempts (notifications and calls ) by the Participant thereof and the Company shall in its sole discretion be entitled to proceed with the next entitled Participant(s) / forfeit the prize under these Rules, in case it is unable to successfully contact and communicate with the Participant or the Participant does not claim the Prize within the timelines.

        31. The responsibility of the fulfilment of the prizes shall be solely of the Partners and the Participants understand and agree that Novi shall not have any responsibility of the same whatsoever.

        32. At no point in time will the Company be obliged to notify unsuccessful Participants of its decision. No enquiries, appeals, verbal or written, shall be entertained in this regard.

        33. All attempts will be made to protect the Participant data along with the points earned from loss and corruption, but in the event that such data loss happens, and because of the intricate timelines of the Winner determination process, the Company may have to continue with whatever data is available, or in any other manner as it may deem reasonable.

        34. We would recommend the Participants to maintain privacy of his/her personal details and not mention the phone number or any other personal details on any social media platform.

        35. Employees of the below mentioned entities are ineligible to claim the Match Prizes:

        • Novi Digital Entertainment Private Limited
        • Star India Private Limited
        • Sports Interactive
        • Mashal Sports
        • Asianet Television
        • Vijay Television
        • Fox Star India

        The employees of the above mentioned organizations, hereon referred to as "White Listed Participants" would be ineligible to claim any Match Prize.

        36. As a platform Novi is responsible to organize the Game, identify the Winners of the Game Play. All Prizes are sponsored by the respective Prize Sponsors.

        37. The Company will have access to and collect Participant's Game Play information and data and any other information submitted by the Participant during the course of Game Play ("Game Play Data") and may use this Game Play Data for the improvement of the Hotstar App and the Game in general, including by analyzing overall Participant behavior/ choices/ trends. By participating in the Game, the Participants consent to the collection, storage, processing and the transfer of and sharing of the Game Play Data by the Company, in accordance with the terms of its Privacy Policy which is accessible at http://www.hotstar.com privacy-policy.

      • 5. Other Terms and Conditions

     

    1.          The Game is meant for entertainment and recreational purposes only, and is not a contest, bet, award or challenge or other form of formal event.

    2.          The Game will be available only when there is an ongoing live Match and when the Hotstar Application is set to view the live Match in portrait mode. The Company will not be responsible for any break or disconnection or disruption in network connectivity in any manner, irrespective of the network being used which results in any break during the Game Play. Network issues can disrupt various aspects of the Game Play such as receipt of questions and answer options, receipt of any sound, text, video streams related to the question, receipt by the Company of answer chosen by the Participant, etc. The Participant is advised to remain in an area with a strong and stable/ continuous mobile network signal of the telecom operator or internet service provider to ensure smooth functioning of the Game Play.

    3.          Any loss or outrage or dissatisfaction suffered during the course of playing the Game Play by a Participant would not be the responsibility of the Company and/or its associates/ affiliates and the Company or its associates/affiliates will not  be responsible to make good any such loss or dissatisfaction.

    4.          In the event the response of the Participant is not received by the Company within the stipulated time period for the question for any reason, the Participant would not get points in the event that question(s) was answered correctly by him/her.  The Participant can continue to answer questions once re-connected to the central Game Play server(s). Company or its vendors and partners are not responsible for any such instances.

    5.          Other than the Devices (defined in point 2.B), the Game Play will not be accessible on portrait mode, or through web browsers, and any third party live TV streaming medium or any other operating systems/platforms on which the Hotstar App is available.

    6.          The Company will endeavor to ensure that the integrity of the game is maintained at all times and will take reasonable steps in this regard

    7.          By agreeing to these Rules & Regulations, you permit the Company to contact you on the India mobile number disclosed by you, even if that number is registered on the Do Not Call/Disturb Registry. 

    8.          The Participant(s) of the Game Play  may be required to make himself/herself available for the Company and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to the him/her. 

    9.          By accepting the Rules & Regulations, the Participant agrees and authorizes the Company to use any information available and linked to his User ID (Email or Facebook ID) provided at the time of registration on the Hotstar App in terms of the Privacy Policy of the Hotstar App available at http://www.hotstar.com/privacy-policy.

     

    6.          SYSTEMS AND AVAILABILITY

     

    1.          Prior to the start of the Game, the Participant must check that the Hotstar App is updated, operational and functioning correctly. The Participant is advised to keep adequate RAM and phone memory available to ensure smooth functioning of the Game. Quitting other applications on the Device will also help towards smoother Game Play in case of some phones.

    2.          Participants may need to adjust the Device display, font, brightness and resolution to default size or lower to ensure that they are able to play the Game on their Devices properly.

    3.          Participant is advised to keep the Device from which the Game is played, adequately charged. Low battery may result in shut down of the network and / or Device which could affect the Participant's ability to play the Game.

    4.          The Company has ensured adequate redundancies with respect to the servers that are used to communicate with the Hotstar App for the Game Play. However, in the rare instance that the servers are affected and are rendered non-functional, the Company will, at its discretion but not as an obligation, determine such measures as it may deem fit, including cancelling certain sections or segments or question(s) from the Game at the discretion of the Company.

    5.          An on-going Participant(s) could lose out on the opportunity to play one or more questions (and hence lose points) in any of the following, but not exhaustive, scenarios:

    a)          Where a Participant answers a call / message / etc. on the Device where he/she is playing the Game;

    b)          Where a Participant exits the Hotstar App while playing the Game;

    c)           Where a Participant force quits an App or restarts his/her Device during Game Play;

    d)          Where there is a network drop or battery drain-out during Game Play;

    e)          Where the Device on which the Game is being played hangs during Game Play;

    f)            Where the Device auto-locks, screen times out during the course of the Game;

    6.          In the event the Game is terminated mid-session for any reason whatsoever, or where the Game or the ability of a Participant to play the Game is affected by any network / IT / phone related issue, and/or where a Participant exits the Game in the middle of an on-going ball, the Participant will be permitted to rejoin the Game only when the next question is about to be displayed.

    7.          The scenarios present hereinabove are only by way of example and there could be additional scenarios, beyond Company's control, wherein the Participant Game Play may be interrupted, and/or the Participant may lose an opportunity to answer any question. Under all such scenarios, the Participant will be permitted to rejoin the Game only when the next ball is played and the Company will not be liable in any manner for such interruption in the Game Play and/or any lost opportunity to answer any of the questions during Game Play, which results from technical and non-technical reasons attributable solely to the Participant, its Device, the internet and/or mobile networks and/or any other force majeure conditions.

    8.          Company will not be responsible for any loss, outrage from or dissatisfaction suffered by the Participant, during Game Play or otherwise arising out of or resulting from the Game in general. Company or its associates/affiliates will not be responsible to make good against any such loss, outrage or dissatisfaction.

    9.          While all attempts will be made to protect the Game Play Data, including the data pertaining to the correct answers given by each of the Participants, from loss and/or corruption, Participants agree and acknowledge that all systems are prone to failure and hacking attempts. In the event of any data loss, Company shall make reasonable endeavors to continue with whatever data available in the manner it deems is fit. The Company will not be responsible for any damage resulting from the loss of data or the action taken by the Company for the continuity of the Game Play, on account of the same. The Company will not be held responsible to make good any loss or dissatisfaction suffered by the Participant, on account of such loss.

    10.       The telecast of the Match on the Hotstar App may not coincide with the telecast of the Match on television (across all types of feeds [HD / SD, etc.] and platforms [DTH / cable / IPTV, etc.]) including the actual match timing in the stadium. This may result in time lag between the actual Match playout in the stadium, its transmission over various networks and the Questions asked in the Game.. Please note that the Company reserves the final right to determine any issues of any time lag and its decision regarding the same shall be final. Pertinently, if the Company learns that this time lag has been used by any Participant to gain any unfair advantage in the Game to win Prizes, the Company reserves the right to immediately suspend / terminate the Participant's Game Play or forfeit the Match Prize won by such Participant, without any prior notice to the Participant. The Company's decision on this will be final and binding.

    11.       The Participant acknowledges and agrees to hold harmless the Company and its partners for the application, network, process, technical or any other failures. Any losses, injury, discomfort, loss of privacy, inability to participate or any other discomfort of any sort caused to the Participant or the Participant's property or device shall not be the responsibility of the Company or its Partners.

    12.       In case any unauthorized activity is observed on the Game, Company reserves the right to disqualify the Participant causing and/or resorting to such unauthorized activity till such time as the Company deems fit. The Company would not be responsible to such Participant in any manner whatsoever on account of such disqualification.

    13.       While the Company shall endeavor to make all reasonably practicable arrangements for the continuity of the Game, it cannot guarantee or assure seamless connectivity or continuous availability of the Hotstar Application, server, system or software to the Participants during the conduct of the Game as these are dependent on external utilities/service providers and factors which could be beyond the control of the Company.

    14.       Company shall not be liable for any failure of the Hotstar Application server or system in the course of playing the Game. 

    15.       Company and its sub-contractors are not responsible for delayed receipt or non-receipt or incomplete receipt or corrupted receipt of answers.

    16.       The Company accepts no liability and shall not be responsible and/or liable in any manner whatsoever in case the Participant(s) are unable to participate in the Game due to failure on the part of the telecom operator, internet service provider, facility provider, etc., or due to capacity constraints.

    17.       In the event the Game Play ceases to operate due to any unforeseen issues, including but not limited to technical issues or force majeure, the Company reserves the right to discontinue the Game for future and revise these Rules and Regulations to accommodate such discontinuation. The Company shall not be responsible or liable for any losses caused due to such discontinuation.

    18.       It shall not be open for the Participant(s) or any of their representatives to require an audit or verification of the any of the systems, databases, software, hardware used to host the Hotstar App or the Game, or any other criteria, process or system adopted by the Company as part of the process of conduct of the Game or selection of winners resulting therefrom.

    19.       No person (i.e., either the Participant or any person on behalf of the Participant) shall initiate litigation against the Company or its partners in any manner, in connection with the Game Play and/or the eligibility and/or the participation in the Game without first writing in to the Company at hello@hotstar.com setting out its concerns/issues and providing the Company a reasonable opportunity to address such concerns/issues.

    1.The Participant's participation in the Game(s) shall be considered to be acceptance of these Rules & Regulations.

    8.The Company has the right at any time to terminate the Game without any prior intimation or notice to the public and the Company is not obligated in any manner whatsoever to compensate any person or persons who have participated in the Game.

    9.If the operation of the Game, the transmission and/or the broadcast of any/all of the Match is prevented by an event of force majeure or otherwise, the Company may cancel all or any part of the Game or take such other decision as it deems fit.

    10.       If any provision of these Rules & Regulations is held by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these Rules & Regulations and the remainder of the affected provisions shall continue to be valid.

    11.       These Rules & Regulations and the Game shall be governed by and construed in accordance with the laws of India and the Participant(s) submit irrevocably to the jurisdiction of the Courts in Mumbai.

    12.       Any dispute or claim arising out of or in relation to the Game Play or these Rules and Regulations shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time, by a sole arbitrator nominated at the sole discretion of the Company. The place of arbitration shall be Mumbai. The Language will be English. The award of the arbitral tribunal is final and binding on the parties.

    13.       The Company is empowered to take a decision on any case not covered by the present Rules and Regulations.

    14.       The Company or any of its affiliates will not be liable for any loss of earnings, employment or otherwise, caused to the Participant(s) and arising as a result of his/her participation in the Game.

Subscription Services

Some of the Content made available on the Site can be availed only by registered Users who have registered under a subscription model ("Subscription User"). Payments

Novi will automatically start billing as per Your selected Payment Method for the Subscription plan elected by You at the time of registration through the third party payment gateway at the end of the free trial period, if applicable unless You cancel the Subscription before the end of the free trial period. The cancellation of the Subscription can be done through the "My Account" section of the Site. It may take a few days for Your payment made to Novi to be reflected in your "My Account" section.

In case You cancel Your Subscription before the end of the free trial period, You will not be entitled to any compensation monetary or otherwise from Novi for the unutilized period of free trial.

You cannot change your Payment Method during the tenure of your Subscription. If Your selected Payment Method is no longer available or expires or Your Payment Method fails for whatsoever reason, You will be responsible and liable for any uncollected amounts and Novi reserves the right to terminate the Subscription offered to You.

The Subscription Fee will be billed at the beginning of Your Subscription membership or at the end of free trial period, as applicable and on each subsequent renewal automatically (as per the Subscription plan chosen by You) unless and until You cancel Your Subscription or the Subscription is otherwise suspended or discontinued pursuant to these Terms. To see the commencement date for Your next renewal period or to cancel Your subscription to the Subscription, You need to visit the "My Account" section on Your profile page. On cancellation of Subscription You will be notified by Novi.

Novi will be automatically billing as per Your Payment Method for each Subscription period on a monthly basis. However, if You change Your membership plan, this could result in changing the day on which You are billed and the amount which You are billed.

In case of change in the Subscription Fee for a particular membership plan that is already opted by You, Novi will give You an advance notice of these changes.

The Subscription Fees specified for each Subscription plan are inclusive of applicable taxes.

The Subscription Fees billed are non-refundable irrespective of whether the Subscription have been availed by You or not.

Any changes in the Subscription Plan opted by You is effective only after the expiry of the current Subscription period for which You have already been billed. Accordingly, the Subscription as per revised plan opted by You shall be effective only after the expiry of the then current Subscription period.

Any request for change or cancellation in any Subscription plan prior to the expiration of the current Subscription plan period will not entail You with a refund for any portion of the Subscription Fee paid by You for the unexpired period.

You also understand and acknowledge that Novi only facilitates the third party payment gateway for processing of payments. This facility is managed by the third party payment gateway provider and You are required to follow all the terms and conditions of such third party payment gateway provider.

You are responsible for the accuracy and authenticity of the information provided by You, including the bank account number/credit card details and any other information requested during the subscription process. You agree and acknowledge that Novi shall not be liable and in no way be held responsible for any losses whatsoever, whether direct, indirect, incidental or consequential, including without limitation any losses due to delay in processing of payment instruction or any credit card fraud.

You can access the status of Your Subscription anytime through the "My Account" section on Your profile page.

You can file any complaint related to payment processing on the Site and the same will be forwarded to the concerned third party payment gateway provider for redressal.

Upon payment through any of the Payment Modes and confirmation of receipt of such payment from the payment gateway provider, an invoice will be made available to You in the "MY Account" section which can be downloaded by You in pdf format.

Upon payment being received by Novi through any of the Payment Method, Novi shall make the Subscription available to You through any of the approved modes of delivery that Novi adopts.

It is hereby clarified that the Subscription offered to You are offered by Novi and not by any third party including any payment gateway service providers.

Novi reserves the right to change, terminate or otherwise amend the Subscription plans, Subscription Fees for the Subscription and billing cycles at its sole discretion and at any time. Such amendments shall be effective upon posting on the Site and Your continued use of the Service shall be deemed to be Your conclusive acceptance of such amendments.

Novi reserves the right to change, supplement, alter or remove any of the Content that is subject to a Subscription Fee as it deems fit. Novi does not guarantee the availability of a specific Content or a minimum Content that is subject to a Subscription Fee.

Post cancellation of Your Subscription, if you wish to re-subscribe to the Subscription, you may do so from Your "My Account" page.

Access and Use of the Services

Limited use:

You are given a limited, non-exclusive, non-transferable, non-sub-licensable, revocable permission to view the Site and avail the Service during the subsistence of Your Account with Novi for the territory of the world or limited territories as applicable in respect of specified Content and as set forth in these Terms and Conditions and no right, title or interest in any Content will be deemed transferred to You.

By agreeing to use/avail the Services:

In case the Site allows You to download or stream any of the Content therein, You agree that You will not use, sell, transfer or transmit the Content to any person or upload the Content on any other website, webpage or software, which may violate/cause damages or injuries to any rights of Novi or its affiliates or any third party including privacy rights, publicity rights, and intellectual property rights.

User Reviews, Comments and Other Material

You may have an opportunity to publish, transmit, submit, or otherwise post (collectively, "Post") only reviews or comments (collectively, "User Material"). As it concerns User Material, without prejudice to Your obligation to otherwise comply with applicable laws during the course of using the Services, You agree to hereby comply with any and all applicable laws, as well as any other rules and restrictions that may be set forth herein or on the Site or Services.

You agree that Novi shall have the right but have no obligation, to monitor User Material and to restrict or remove User Material that Novi may determine, in its sole discretion, is inappropriate or for any other reason. Governing Law and Jurisdiction

The relationship between You and Novi shall be governed by the laws of India without regard to its conflict of law provisions and for resolution of any dispute arising out of Your use of the Services. Notwithstanding the foregoing, You agree that (i) Novi has the right to bring any proceedings before any court/forum of competent jurisdiction and You irrevocably submit to the jurisdiction of such courts or forum; and (ii) any proceeding brought by You shall be exclusively before the courts at Mumbai, India.

Severability

If any provision of these Terms and Conditions is held invalid, void, or unenforceable, then that provision shall be considered severable from the remaining provisions, and the remaining provisions given full force and effect.

Changes

Novi reserves the right, at any time and from time to time, without prior notice to You, to update, revise, supplement, and otherwise modify these Terms of Use and to impose new or additional rules, policies, terms, or conditions on Your use of the Service. Any updates, revisions, supplements, modifications, and additional rules, policies, terms, and conditions (collectively referred to in this Terms of Use as "Revised Terms") will be posted on the Site and will be effective immediately after such posting and thereafter incorporated into these Terms and Conditions.
