1. KEY RULES & REGULATIONS GOVERNING PARTICIPATION IN WATCH ‘N PLAY

 

1.     The Watch ‘N Play game is available only in English language and in portrait mode of the Hotstar app.

2.     Existing Hotstar users must upgrade their app to the latest version from the App store or Play Store to participate.

3.     New users can access the Game by downloading the Hotstar App from the App store or Play Store.

4.     Although the Participant can participate in the Game without registering, he/she will be able to redeem the vouchers / prize only after registration on the Hotstar App.

5.     The participant can register through his/her email ID or can log in through his/her Facebook account or their phone number.

6.     The version of the Watch ‘N Play game released for playing along with matches of the India – New Zealand cricket series played between 26th January, 2019 to 10th February, 2019 and India – Australia cricket series played between 24th February 2019 to 13th March 2019 (‘Watch ‘N Play Beta’), is a test / beta version of the Game, which will be exclusively available on the Hotstar App. The term ‘Game’ includes Watch ‘N Play Beta version of the Game.

7.     The Watch ‘N Play Beta will be made available on to limited number of users basis following criteria:

a.     Only users that update their Hotstar App will be eligible for selection;

b.     Users will be shortlisted through a randomization process

c.      The above list is merely indicative and shall not be treated as determinative of who may be selected for the Watch ‘N Play Beta game.

d.     Hotstar Users understand and agree that they do not have a legal right to play the Game and waive any right to object to the random selection of the Participants for Watch ‘N Play Beta.

e.     The Company’s selection of the users shall be final and binding.

f.       The Company reserves the right to change/modify the Watch ‘N Play Beta selection criteria without any prior notice and will not be responsible for any queries or objections from any users (whether selected or not selected).

8.     The invitation for participation in the Watch ‘N Play Beta game is not transferable to any other Device other than the Device on which it has been made available by The Company.

9.     The Watch ‘N Play Beta game is released to test the various functionalities, prior to release of the Watch ‘N Play Game for access by all Hotstar users.

10.  All Participants of Watch ‘N Play Beta understand and agree that functionalities and features may not operate at all and/or as desired. All Participants of Watch ‘N Play Beta also understand and agree that the final release of the Game may contain additional features and options which are presently not incorporated in this Beta version of the Game.

11.  Any Participant of Watch ‘N Play Beta game does so at his or her own risk, and understands that Watch ‘N Play Beta, the Hotstar Application and system may not operate as desired.  The Company shall not be liable for any damages or  claims arising from Watch ‘N Play Beta, whatsoever.

12.  The Company will have access to and collect information and data related to the playing of the Game by the Participant during the course of Game Play (“Game Play Data”). The Participant consents to the use of this Game Play Data by The Company for research and development for a better gaming experience, including but not limited to understanding the functioning of the Game, mapping general participant behavior in response to the features of the Game, the improvement of the Hotstar Application and the Game in general, etc. By participating in the Game, the Participants consent to the collection, storage, processing and the transfer of and sharing of the Game Play Data by the Company, in accordance with its Privacy Policy which is accessible at http://www.hotstar.com/privacy-policy.

13.  The Company reserves the right to modify and/or cancel any Game based on programming, technical requirements, unfavorable climatic conditions and/ or any other reasons as The Company may deem fit. The Game in such circumstances could be rescheduled, extended, cancelled or terminated in entirety.

14.  Watch ‘N Play Game will require the participants to answer two types of questions:

g.     Trivia Questions with three answer options. These questions may also involve questions related to the sponsors of the Game.

h.     Contextual questions with three answer options. The final outcome in terms of total runs scored by the team on any given ball would be considered as the right outcome of contextual questions, except in cases where the final outcome has resulted in the loss of a wicket.

 

The scores associated with each correct answer for Trivia Questions shall be between 30 points to 1000 points. The points allocated to each question shall be done at the discretion of the Company.

15.  The indicative scores associated with each correct answer for Contextual Questions is given below:

The Company reserves the right to change the Points structure for the questions without any prior notice to the users.

The points assigned to each question shall be displayed on the screen of the users.

16.  Participant’s scores and / or prizes will be transferable from one device to another provided the participant uses the same Email id / Facebook ID or phone number, which the Participant used for the purpose of registration with Hotstar, inter alia, to play the Game and/or claim Prize.

17.  The Game can be best experienced when the Hotstar App notifications have been turned on.

18.  All Participants are advised to remain in areas with strong and stable/continuous mobile network signal of the telecom operator or internet service provider to ensure smooth functioning of the Game.

19.  Watch ‘N Play Beta shall be available for play in rounds, wherein Voucher Prizes are available for each round and the Participant will be eligible to win prizes only for the rounds that the Participant plays.

20.  All selected Participants to Watch ‘N Play Beta are eligible to win the Round Wise Offer Prizes, i.e. Participants can win Voucher Prizes available for each round by playing the rounds.

21.  Only registered users will be eligible for Prize Fulfilment.

22.  Decisions made by the Company shall be final and the Company shall not be responsible for factors including but not limited to loss of data/points or any other advantage/disadvantage caused to Participants due to technical errors or issues in their device, application, log-in interface (Email id, Facebook account or phone number), internet connection and/or network coverage.

  1. The Company recommends the Participants to maintain privacy of his/her personal details and not mention the phone number or any other personal details associated with the Hotstar App on any social media platform.
  2. The Social Media Feed will be visible to all Participants of the Game but only a User who has logged in using his / her Facebook ID will be eligible to submit a comment for the Social Media Feed. The Company has the sole discretion to decide whether to publish a comment submitted by a Participant on the Social Media Feed of the Watch ‘N Play Beta Game. The Company will not be responsible or liable for any claims regarding the exercise of the Company’s discretion in this regard.

25.  In case of any queries, please write to hello@hotstar.com setting out your concerns/issues related to the Game. All endeavors shall be made to reply to the queries within reasonable time on a best effort basis. However, the absence of a reply shall not be deemed to mean acceptance by the Company of any claims made in the query.

LONG FORM (Detailed) RULES & REGULATIONS GOVERNING PARTICIPATION IN

WATCH ‘N PLAY

 

 

1.          CONTEST DESCRIPTION:

 

“Watch ‘N Play” is a skill based online game (‘the Game’) which is being hosted and can be played on the Hotstar Application which is owned and operated by Novi Digital Entertainment Private Limited. The Game is meant to test the Participant’s knowledge of cricket or Sponsors, and the Participant’s ability to gauge tactics, situations, forms, strategies, and performance.

 

2.          DEFINITIONS:

 

1.          For the purposes of the Rules & Regulations, the expressions used herein shall have the meaning ascribed to them as below:

a.          “Airtel subscriber” or “Airtel Participant” is a subscriber of telecom services provided by Bharti Airtel Limited

b.          “Company” or “NDEPL” means Novi Digital Entertainment Private Limited; and includes its associates and affiliates for the purposes of this Game

c.           “Device(s)” shall mean mobile phones running the Android (with version 7.8.2 and above) / iOS (with version 10 and above) operating platforms, capable of receiving and transmitting data including via Internet and/or mobile communications technology and/or any other similar technology. The Game may work on sim-based tablets and devices other than smartphones operating on the android (version 7.8.2 and above) and iOS (version  10 and above) operating platforms, however, we recommend the Participant to play the Game on smartphones for a better user experience;

d.           “Hotstar Application” or “Hotstar App” means the audio-visual streaming platform currently branded as “Hotstar” and accessible from the Device(s);

e.          “Hotstar User(s)”  shall mean any person who accesses the content on the Hotstar App

f.           “Intellectual Property” shall include but not limited to the Watch ‘N Play Game, creatives, game format, prize format, scoring format, all trademarks and copyrights obtained by the company for the purposes of this Game, IT infrastructure design, domain names and terminologies used in this document to define specific aspects of the Game

g.           “Jio subscriber” or “Jio Participant”, is a subscriber of telecom services provided by Reliance Jio Infocomm Limited.

h.          “Match(es)” means a professional game of One Day International (“ODI”) or T20 cricket match.

i.            “Premium Subscriber” is a Registered User who has availed the paid subscription or the sports pack on the Hotstar App to enable viewing of content on the App.

j.            “Prize(s)” shall mean all Voucher Prize(s), and any other prize(s) or offers or coupons that a Winner may be eligible to receive, as may be determined and announced by the Company in terms of these Rules and Regulations.

k.           “Registered User(s)” means a person who registers on the Hotstar App through an e-mail ID, phone number or Facebook ID to access and / or play the Game Play.

l.            “Rules & Regulations” means these rules and regulations governing the Game, as stated herein in entirety and as may be amended by the Company from time to time without prior notice, and includes Key Rules accompanying the version of the Game in play;

m.         “Score(s)” or “Point(s)” means the points earned and the score achieved by a Participant while playing the Game.

n.          “Scoring round(s)” means the different rounds categorized to be eligible for different types of Prizes and the points that a Participant has to score to win prizes in each such round.

o.          “Season” means the entire season of cricket series played between two teams.

p.           “Sponsor” or “Prize Sponsors” or “Partners” means a partner who has approached Hotstar for a tie up for its marketing initiatives and is associated with this Game and is distributing voucher prizes based on the rules and regulations mentioned herein, voluntarily.

q.          “Social Media Feed” shall refer to the data format whereby text comments submitted by Participant(s) who have logged in using their Facebook ID, email or phone number are published and frequently updated at the discretion of the Company and are visible to all Participants of the Game.

r.            “Stipulated Time” for the purposes of the Game shall mean either (i) the period until which the Company permits a Participant to answer any question forming part of the Game; or (ii) the time taken by the Participant to answer the question, whichever is lower, subject to a maximum of 10 seconds.

s.           “Voucher Winner(s)” means such Participants who have unlocked vouchers by clearing the defined Scoring rounds and are eligible for Voucher Prize(s).

t.           “Voucher Prize(s)” means discount or complimentary coupons or any Sponsor specified coupon of pre-decided value from sponsors made available to participants who are eligible to be Voucher Winner(s).

u.          “Watch ‘N Play” or “the Game” or “Game Play” means the online game titled “Watch ‘N Play” available on the Hotstar App which may be played by the Participants on the Device(s) in accordance with the Rules & Regulations, and includes all versions of the Game.

v.           “Watch ‘N Play Beta” or “the Beta Version” means the version of Watch ‘N Play released for the matches in the India-New Zealand series played between 26th January and 10th February, 2019 and India – Australia series played between 24th February 2019 and 13th March 2019.

w.         “Watch ‘N Play Participant(s)” or “Participant(s)" refers to a user who (i) has downloaded the latest version of Hotstar App on his/her Device, (ii)has accepted the Terms & Conditions of Watch ‘N Play, (iii)plays the Game on the Hotstar App (iv) is present in India and who (v) is of sound mind and health.

x.           “Winners” shall mean all Voucher Winners, or any other winners as may be determined and announced by the Company in terms of these Rules & Regulations.

 

3.          PROCEDURE TO PARTICIPATE IN THE GAME:

      i.         Eligibility & Participation

 

1.          The Watch ‘N Play is made available in English exclusively on the standalone Hotstar App of the Company as accessible on the Devices.

2.          Existing Hotstar users who wish to participate need to upgrade the Hotstar App in order to access the Game Play. New Hotstar users can access the Watch ‘N Play by downloading the Hotstar App from the Play store / App Store and accepting the Terms and Conditions of the Game.

3.          The Watch ‘N Play Beta game will be made available to limited number of users basis following criteria:

4.          The Game Play will work on Android (version 7.8.2 and onwards) and iOS (version 10 onwards) smartphones only. The Game Play may work on tablets and devices other than smartphones operating on the android (version 7.8.2 onwards) and iOS (version 10 onwards) operating platforms. However, we recommend the Participant to play the Game on smartphones for better user experience. The Participant is required to check compatibility on his/her device before the Game Play. The Participant should access the Game Play from another device in the event the Game Play does not work on a device.

5.          The Game Play may work only in the territory of India and shall not be accessible from other territory (ies) across the world. To participate in the Game Play, the Hotstar user should(i)accept the Terms & Conditions of Watch ‘N Play ,(ii)play the Game on the Hotstar App, (iii) be present in India and (iv) be of sound mind and health.

6.          In case the Participant is below the age of 18 years, the Parent and / or Guardian of the Participant consent to his/her participation in the Game and agree with the Rules and Regulations of the Game and undertake to abide by all the terms and conditions contained herein.

 

     ii.         Registration

 

1.          The Hotstar Terms of Use available at http://www.hotstar.com/terms-of-use shall apply in relation to the Participant’s registration on the Hotstar App.

2.          By registering through Facebook, the Hotstar User allows the Company to access the information available in the Participant’s Facebook account. The Participant can change this by changing the privacy settings for his/her Facebook account.

3.          Prior to proceeding, the Hotstar User agrees to the Rules and Regulations governing the Game Play.

4.          All Hotstar Users that participate in the Game Play shall be deemed to have read the terms and conditions and the privacy policy http://www.hotstar.com/privacy-policy and accepted all the Rules and Regulations as defined herein and updated from time to time. In case of change in Terms and Conditions, Company will notify Participants through Hotstar App.

 

5.          The Watch ‘N Play Beta game is available to selective Hotstar Users, and is accessible for viewing and/or playing, for the duration of the live broadcast of the Match (on any medium), including the pre-Match and post-Match presentations and programming. However, in order to view and/or redeem the Prizes won by a Hotstar User who is a Participant, the Hotstar User will have to become a Registered User. Upon becoming a Registered User, the Prizes won by a Hotstar User will be displayed in the “My Prizes” section of the Hotstar App.

6.          The Email id, Facebook account or phone number through which the Participant plays the Game shall be the unique identifier for the respective Participant. Participants are advised to use Email or Facebook IDs or phone numbers  to be clearly identifiable as the Participant of the Watch ‘N Play.

7.          The Game points shall accrue to the unique identifier based on log in through email id, Facebook account or phone number. The user will be able to log in on multiple devices using the same log in email id/ Facebook id/ Phone number.

8.          If a device has been accumulating points as an unregistered user, the user registered first on that device through his email id or facebook account or phone number, will receive the points accumulated till then on that device..

9.          Points shall  be transferable between any devices and points will accrue to the ID used by a Hotstar User to register on the Device. Registration is mandatory for the purposes of viewing / redeeming Prizes, but is not required to play the Game.

10.       In case of loss of Participant Scores due to loss of phone, data loss, login / logout issues or any other technical glitches, the Company shall not be responsible to identify the actual Participant who has played the Game Play and no questions / queries or requests in this regard shall be entertained. The Company’s decision on whether the Participant should be credited unclaimed points shall be final and binding on all Users that participate in the Game Play. In case the Company identifies any malpractice/ fraudulent usage / unfair advantage including but not limited to use of cheats, exploits, automation, software, bots or any unauthorised third party software, the Company  reserves the right to disqualify the Participant without any prior notice/intimation.

11.       The Participant will not be able to answer the questions displayed during the game when the participant is in the process of registering or subscribing on the Hotstar app. 

12.       Registering on the App does not necessarily entitle the Participant to be eligible to win a prize.

13.       The Participant may be notified by any form of in app messaging and/or a pop-up and/or a display, requesting them to become a registered user of the Game, so as to be able to redeem Prizes.

 

     iii.        Charges for Watch ‘N Play

 

1.          Please note that the Hotstar App download is free of cost, however, the viewing of the Match, live or otherwise, along with access and play of the Game Play shall use data. Therefore, the use of the Hotstar App and the Game Play will result in the use and consumption of data for which data charges as charged by your internet / telecom operator may apply. For further details, please contact your internet / telecom operator.

2.          It will be responsibility of the Hotstar User to understand and enquire charges as may be applicable with his/her internet / telecom operator.  In case any Participant uses the Hotstar App or plays the Game Play while roaming in a different circle/zone, additional roaming rates may apply. Please contact your internet / telecom operator for applicable rates.

3.          The Company will not and does not receive any monies and/or consideration from the internet / telecom operators and/or any third party, in connection with the data consumed by the Participant for the Game Play

 

4. WATCH ‘N PLAY

 

i.               I. Tentative Match Schedule

 

1.          The Game will be made available for Game Play on the Hotstar App on select Matches

2.          The continued live access to matches on Hotstar App is available to Hotstar Premium or Hotstar All Sports subscribers only.

3.          Broadcast of the Matches could be modified or cancelled based on programming, technical requirements, unfavorable climatic conditions or any other reasons as the event organizer or the Company may deem fit. The Watch ‘N Play Game in such circumstances may be rescheduled, extended, cancelled or terminated in entirety.

 

ii.               II. Game Format

 

1.          Watch ‘N Play shall require the Participant(s) to answer 2 types of questions:

a.          Trivia Questions

i.          Trivia Questions are based on the general knowledge about cricket or it may also involve questions related to the sponsors of the Game Play. (“Trivia Questions”)

ii.          An example of a Format of Trivia Questions, could be - ‘What is the full form of D/L method?’

iii.          Each Trivia Question will have 3 (three) answers options to choose from

iv.          The points associated with each trivia question will be indicated next to the question on the screen.

 

b.          Contextual Questions

i.          Contextual Questions are based on testing the Participant’s knowledge about cricket and ability to gauge tactics, situations, forms, strategies, and performance. (“Contextual Questions”)

ii.          Contextual Questions, will be in the form of, ‘What will be the outcome of the next ball?’

iii.          The final outcome in terms of total runs scored by the team on any given ball would be considered as the right outcome of contextual questions, except in cases where the final outcome has resulted in the loss of a wicket.

iv.          The answers to the contextual questions have been categorized into four categories as mentioned below:

c.           Round(s) Format

Each ODI Match will have 10 rounds of 10 overs each. Each T20 Match will have 10 rounds of 4 overs each. The users would be able to view the points scored in each round.

2.      Prizes shall be awarded for each round, as per the points earned by the Participant during such round.

3.          The Company reserves the right to add more answer options, and also take appropriate action in case of any answer option that do not qualify in the table above.

4.          The order and frequency in which each type of Question may be asked is at the sole discretion of the Company.

5.          During each Match the Participant will have to provide answers for each Question within the stipulated answer time, from the time the question appears on the Participant’s Device. The Participant will win points as per the ‘Scoring’ process (detailed in section III) and be eligible to be included in the Match.

6.          The Company may increase and/or reduce the stipulated answer time to answer each Question at its sole discretion and the decision of the Company in this regard, will be final and binding on the Participant(s).

7.          Once the Participant selects a particular option/answer for the question presented during the Game Play, the Participant will not be allowed to change the option/answer. If for any technical and/or non-technical reasons, the Company’s servers fail to register any option/answer provided and/or selected by the Participant, the Company, shall not be responsible for such delayed receipt or non-receipt or incomplete receipt or receipt of corrupted answers.

8.          The Participant may be notified by any form of in app messaging and/or a pop-up and/or a display, upon the receipt of the correct and/or incorrect answers. Only those options/answers which are received within the Stipulated Time, will be considered valid.

9.          In the event the Participant’s responses to any of the questions during the Game Play, is not received within the Stipulated Time due to any unforeseen reasons or errors including but not limited to technical or network errors or glitches, the Participant will not be allotted any points for answering the question, notwithstanding the fact that the Participant may have correctly answered the question through the Device.

10.       In case multiple answer entries are received from Participant(s) for the same question, due to any unforeseen reasons or errors including but not limited to technical or network errors or glitches, the Company may at its sole discretion, choose the answer received at the first and foremost attempt by the Participant as recorded in the Company’s servers.

11.       The Company reserves the right to revise the points earned by each Participant and update with the revised points in case the actual outcome of the ball is different from the answer of the question displayed on the Hotstar App during the Game Play.

12.       The Company will not entertain any claims/questions/queries with respect to the authenticity and/or correctness of any questions and answers for these questions asked during any of the Matches.

13.       The Company’s decision on the correctness or incorrectness is final and binding on all Contestants.

 

 

iii.               III. Scoring

 

 

1.          The Participant(s) may win points as per the below table, as provided for within the Hotstar App for every correct answer of a Contextual Question and/or a Trivia Question:

        The scores associated with each correct answer for Trivia Questions shall be 30 points. The    points allocated to each question shall be done at the discretion of the Company.

2.          No points will be lost on incorrect answers.

3.          Participant points that are available and logged with the Company on the Company’s servers shall be final and binding on all Participants. Mismatches between the points on the Company’s servers and Participant’s Devices could be for reasons such as (but not limited to) technology limitations, internet data breakdown, login issues and disconnection of data link. Company shall not be liable to the Participants in any manner for such mismatches.

4.          In the event where the actual outcome of the ball is different from the answer displayed on the Participant’s device, the relevant points will be granted to Participants who have selected either of answer options

iv.              Uninstalling/reinstalling the App may lead to loss of points. The Company shall not be responsible for any such loss. The Company shall not entertain any claims for any such loss.  

v.              IV. Winner determination and Prize Fulfilment

 

1.          You may become eligible to receive Voucher prize on the basis of scoring points as per the below applicable scoring grid within each round:

2.          Each Match will offer vouchers for scoring the point mentioned in the Points Grid, called Voucher Prizes, fulfilled by the following Prize Sponsors. Each Voucher Prize can be used as per the terms specified by the fulfilling Prize Sponsor.

3.          The Voucher Prize applicable for each scoring level within the grid will be displayed on the screens of the user for each round during the live match.

4.          The Company reserves its right to change the Points Grids and/or the offers relevant to any Points Grids or Scoring rounds at any given time.

5.          In the event any Prize has to be suspended or becomes unavailable due to any reason, including but not limited to technical issues, force majeure, fraud, hacking, etc. the Company reserves the right to revise the Scoring rounds and the Prizes at its sole discretion. The Company may decide to add/modify Prizes at any given time. The Participant shall not be permitted to question or challenge any such revision by the Company.

6.          On participating in each round and achieving the cumulative target points the Participant may become eligible to win a Voucher Prize. The Participants that have reached / crossed the indicative Scoring rounds shall be notified regarding their Voucher Prize at the end of the over in which the Voucher Prize has been won.

7.          Prizes are visible, and can be redeemed, only after registration, from the “My Prizes” tab of the Hotstar App.

8.          On registering, the respective voucher codes for redeeming the Voucher Prizes shall be credited to and visible in the “My Prizes” tab of the Participant’s Hotstar application.

9.          While the Company may allow visibility of the “My Prizes” tab on the Hotstar App upto 31 March 2019, Participants are expected to retrieve the coupons within 15 days of winning any voucher/prize.

10.       For any queries/complaints or clarification in relation to the redemption of the Voucher on the Partner platform, please contact the respective Partner as per the details mentioned in Voucher terms.   

11.       The Company will not permit or entertain any requests or claims to check / audit / challenge the logic of the factors relevant for determining rankings.

V. Social Media Feed

30.       A Social Media feed will be visible for the duration of the Game.

31.       The Social Media Feed will be visible to all Participants of the Game but only a User who has logged in the Hotstar App using his / her Facebook ID will be eligible to submit a comment for the Social Media Feed.

32.       A comment in the Social Media Feed can consist only of text content or emojis.

33.       The Company has the sole discretion to decide whether to publish a comment submitted by a Participant on the Social Media Feed of the Game. The Company at its sole discretion reserves the right to make the comments visible to public (publish) in any order as deemed fit by itself.

34.       The Company will not be responsible or liable for any claims regarding the exercise of the Company’s discretion in this regard. The Company shall not entertain any queries, complaints, claims etc. in this regard.

35.       Comments which may cause any harm to religious sentiments, political in nature, obscene, vulgar, derogatory remarks, inciting violence or threatening, objects that disturb national harmony, racist or sexist remarks, potentially objectionable subject matter such as nudity, sex, profanity, out of context comments, disrespecting the nation, armed forces or any other matters which are perceived to be not in the interest of the general public or may cause harm in any nature or are distasteful, irrespective of any language used whatsoever will be restricted / filtered by The Company.

36.       The Company shall not be held responsible for any kind of claims, damages, outrage arising due to the comments posted by the Participant. Additionally, the Company shall not be held responsible for any violation of intellectual property rights that may arise out of any content posted by the users.

 

5.         Other Terms and Conditions

 

1.          The Game is meant for entertainment and recreational purposes only, and is not a contest, bet, award or challenge or other form of formal event.

2.          The Game will be available only when there is an ongoing live Match and when the Hotstar Application is set to view the live Match in portrait mode. The Company will not be responsible for any break or disconnection or disruption in network connectivity in any manner, irrespective of the network being used which results in any break during the Game Play. Network issues can disrupt various aspects of the Game Play such as receipt of questions and answer options, receipt of any sound, text, video streams related to the question, receipt by the Company of answer chosen by the Participant, etc. The Participant is advised to remain in an area with a strong and stable/ continuous mobile network signal of the telecom operator or internet service provider to ensure smooth functioning of the Game Play.

3.          Any loss or outrage or dissatisfaction suffered during the course of playing the Game Play by a Participant would not be the responsibility of the Company and/or its associates/ affiliates and the Company or its associates/affiliates will not  be responsible to make good any such loss or dissatisfaction. Under no circumstances whatsoever, will the Participant be entitled to claim any damages against the Company and/or its associates/ affiliates  including but not limited to General and Special Damages, Consequential , Pecuniary and Non-Pecuniary, Liquidated, Aggravated, Exemplary Damages, Compensatory and Non-Compensatory, Nominal and Damages for Loss of Profit/ Loss of Opportunity.

4.          In the event the response of the Participant is not received by the Company within the stipulated time period for the question for any reason, the Participant would not get points in the event that question(s) was answered correctly by him/her.  The Participant can continue to answer questions once re-connected to the central Game Play server(s). Company or its vendors and partners are not responsible for any such instances.

5.          Other than the Devices (defined in point 2.1.C), the Game Play will not be accessible on landscape mode, or through web browsers, and any third party live TV streaming medium or any other operating systems/platforms on which the Hotstar App is available.

6.          The Company will endeavor to ensure that the integrity of the game is maintained at all times and will take reasonable steps in this regard

7.          By agreeing to these Rules & Regulations, you permit the Company to contact you on the India mobile number disclosed by you, even if that number is registered on the Do Not Call/Disturb Registry. 

8.          The Participant(s) of the Game Play may be required to make himself/herself available for the Company and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the him/her. 

9.          By accepting the Rules & Regulations, the Participant agrees and authorizes the Company to use any information available and linked to his User ID (Phone number, Email or Facebook ID) provided at the time of registration on the Hotstar App in terms of the Privacy Policy of the Hotstar App available at http://www.hotstar.com/privacy-policy.

10.       None of the Participants shall, without the prior written approval of the Company, speak to the press or any other media or any third person, nor give any interviews or comments relating to any aspect of the Game. The Participant shall not disclose any information whatsoever relating to the Company to any other party including screen shots of the Game on social media websites.  Violation of this clause shall immediately disqualify the Participant’s prospects of further participation.

 

6.            Systems and availability

 

1.          Prior to the start of the Game, the Participant must check that the Hotstar App is updated, operational and functioning correctly. The Participant is advised to keep adequate RAM and phone memory available to ensure smooth functioning of the Game. Quitting other applications on the Device will also help towards smoother Game Play in case of some phones.

2.          Participants may need to adjust the Device display, font, brightness and resolution to default size or lower to ensure that they are able to play the Game on their Devices properly.

3.          Participant is advised to keep the Device from which the Game is played, adequately charged. Low battery may result in shut down of the network and / or Device which could affect the Participant’s ability to play the Game.

4.          The Company has ensured adequate redundancies with respect to the servers that are used to communicate with the Hotstar App for the Game Play. However, in the rare instance that the servers are affected and are rendered non-functional, the Company will, at its discretion but not as an obligation, determine such measures as it may deem fit, including cancelling certain sections or segments or question(s) from the Game at the discretion of the Company.

5.          An on-going Participant(s) could lose out on the opportunity to play one or more questions (and hence lose points) in any of the following, but not exhaustive, situations:

a)          Where a Participant answers a call / message / etc. on the Device where he/she is playing the Game;

b)          Where a Participant exits the Hotstar App while playing the Game;

c)           Where a Participant force quits an App or restarts his/her Device during Game Play;

d)          Where there is a network drop or battery drain-out during Game Play;

e)          Where the Device on which the Game is being played hangs during Game Play;

f)           Where the Device auto-locks, screen times out during the course of the Game;

6.          In the event the Game is terminated mid-session for any reason whatsoever, or where the Game or the ability of a Participant to play the Game is affected by any network / IT / phone related issue, and/or where a Participant exits the Game in the middle of an on-going ball, the Participant will be permitted to rejoin the Game only when the next question is about to be displayed.

7.          The situations present hereinabove are only by way of example and there could be additional situations, beyond Company’s control, wherein the Participant Game Play may be interrupted, and/or the Participant may lose an opportunity to answer any question. Under all such scenarios, the Participant will be permitted to rejoin the Game only when the next ball is played and the Company will not be liable in any manner for such interruption in the Game Play and/or any lost opportunity to answer any of the questions during Game Play, which results from technical and non-technical reasons attributable solely to the Participant, its Device, the internet and/or mobile networks and/or login issues through Facebook account, Email id or phone number and/or any other force majeure conditions.

8.          Company will not be responsible for any loss, outrage from or dissatisfaction suffered by the Participant, during Game Play or otherwise arising out of or resulting from the Game in general. Company or its associates/affiliates will not be responsible to make good against any such loss, outrage or dissatisfaction.

9.          While all attempts will be made to protect the Game Play Data, including the data pertaining to the correct answers given by each of the Participants, from loss and/or corruption, Participants agree and acknowledge that all systems are prone to failure and hacking attempts. In the event of any data loss, Company shall make reasonable endeavors to continue with whatever data available in the manner it deems is fit. The Company will not be responsible for any damage resulting from the loss of data or the action taken by the Company for the continuity of the Game Play, on account of the same. The Company will not be held responsible to make good any loss or dissatisfaction suffered by the Participant, on account of such loss.

10.       The telecast of the Match on the Hotstar App may not coincide with the telecast of the Match on television (across all types of feeds [HD / SD, etc.] and platforms [DTH / cable / IPTV, etc.]) including the actual match timing in the stadium. This may result in time lag between the actual Match playout in the stadium, its transmission over various networks and the Questions asked in the Game. Please note that the Company reserves the final right to determine any issues of any time lag and its decision regarding the same shall be final. Pertinently, if the Company learns that this time lag has been used by any Participant to gain any unfair advantage in the Game to win Prizes, the Company reserves the right to immediately suspend / terminate the Participant’s Game Play or forfeit the  Prize won by such Participant, without any prior notice to the Participant. The Company’s decision on this will be final and binding.

11.       The Participant acknowledges and agrees to hold harmless the  Company and/or any of its affiliates and its Partners for the application, network, process, technical or any other failures. Any losses, injury, discomfort, loss of privacy, inability to participate or any other discomfort of any sort caused to the Participant or the Participant’s property or device shall not be the responsibility of the Company or its Partners.

12.       In case any unauthorized activity is observed on the Game, Company reserves the right to disqualify the Participant causing and/or resorting to such unauthorized activity till such time as the Company deems fit. The Company would not be responsible to such Participant in any manner whatsoever on account of such disqualification.

13.       While the Company shall endeavor to make all reasonably practicable arrangements for the continuity of the Game, it cannot guarantee or assure seamless connectivity or continuous availability of the Hotstar Application, server, system or software to the Participants during the conduct of the Game as these are dependent on external utilities/service providers and factors which could be beyond the control of the Company.

14.       Company shall not be liable for any failure of the Hotstar Application server or system in the course of playing the Game. 

15.       Company and its sub-contractors are not responsible for delayed receipt or non-receipt or incomplete receipt or corrupted receipt of answers.

16.       The Company accepts no liability and shall not be responsible and/or liable in any manner whatsoever in case the Participant(s) are unable to participate in the Game due to failure on the part of the telecom operator, internet service provider, facility provider, etc., or due to capacity constraints.

17.       In the event the Game Play ceases to operate due to any unforeseen issues, including but not limited to technical issues or force majeure, the Company reserves the right to discontinue the Game for future and revise these Rules and Regulations to accommodate such discontinuation. The Company shall not be responsible or liable for any losses or damages caused due to such discontinuation. Company reserves the right to make Watch N’ Play game available during a Live Match. Company will not be held responsible for any enquiries or complaints or claims for non-availability of Watch N’ Play game during a live match.

18.       It shall not be open for the Participant(s) or any of their representatives to require an audit or verification of the any of the systems, databases, software, hardware of the Company and/or any of its affiliates and its Partners used to host the Hotstar App or the Game, or any other criteria, process or system adopted by the Company as part of the process of conduct of the Game or selection of winners resulting therefrom.

19.       No person (i.e., either the Participant or any person on behalf of the Participant) shall initiate litigation against the Company or its partners in any manner, in connection with the Game Play and/or the eligibility and/or the participation in the Game without first writing in to the Company at hello@hotstar.com setting out its concerns/issues and providing the Company a reasonable opportunity to address such concerns/issues.

 

7.        Intellectual property

 

The intellectual property rights ("Intellectual Property Rights") in Hotstar App, underlying Company and the Company Platform, and material published on Hotstar App, including (but not limited to) games, Contests, software, advertisements, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings and Flash animation, is owned by Company, its partners, licensors and/or associates. Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on Company either in whole or in part without express written license from Company

 

8.       User conduct

 

1.       Participant agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of any computer or server used to offer or support Company or the Company Services.

 

2.       Participant shall not attempt to gain unauthorised access to the user accounts, Servers or networks connected to Company services by any means other than the user interface provided by Company, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that underlies or is part of Company services.

 

3.       Participant shall not attempt to Transmit content regarding services, products, surveys, contests, pyramid schemes, spam, unsolicited advertising or promotional materials, or chain letters.

 

 

9.       GENERAL TERMS AND CONDITIONS

 

1.  The Participant’s participation in the Game(s) shall be considered to be acceptance of all Rules & Regulations as set forth herein.

2.  The Participant hereby represents that he/she is not under any contracts, exclusive or otherwise, with any other third party/ agency or is not under any kind of disqualification or disability under law, to enter into an agreement with the Company or its affiliates, as the case may be.

6.  In the event of any fault, misunderstanding or dispute concerning any part of the Game, and/or the operation of the telephone system, internet system, or the validity of any question or answer options, the decision of the Company shall be final and binding on all Participant(s) and other persons. The Company is empowered to take a decision on any case or instances not covered by the present Rules & Regulations.

7.  The Company reserves the right to amend (add, delete or modify) the Rules & Regulations prospectively or retrospectively, at its discretion and without prior approval in order to improve the Game or remediate any issues that may occur. 

8.  The Company has the right at any time to terminate the Game without any prior intimation or notice to the public and the Company is not obligated in any manner whatsoever to compensate any person or persons who have participated in the Game.

9.  If the operation of the Game, the transmission and/or the broadcast of any/all of the Match is prevented by an event of force majeure or otherwise, the Company may cancel all or any part of the Game or take such other decision as it deems fit.

10.    If any court or other competent authority to be void or unenforceable in whole or part holds any provision of these Rules & Regulations, the other provisions of these Rules & Regulations and the remainder of the affected provisions shall continue to be valid.

11.    These Rules & Regulations and the Game shall be governed by and construed in accordance with the laws of India and the Participant(s) submit irrevocably to the jurisdiction of the Courts in Mumbai.

12.    Any dispute or claim arising out of or in relation to the Game Play or these Rules and Regulations shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time, by a sole arbitrator nominated at the sole discretion of the Company. The place of arbitration shall be Mumbai. The Language will be English. The award of the arbitral tribunal is final and binding on the parties.

13.    The Company is empowered to take a decision on any case not covered by the present Rules and Regulations.

14.    The Company or any of its affiliates will not be liable for any loss of earnings, employment or otherwise, caused to the Participant(s) and arising as a result of his/her participation in the Game.

15.    The Participant(s) hereby agree to indemnify the Company or its affiliates against any claims that might arise from their actions or omissions while participating in the Game.

16.    The Participant hereby agrees and undertakes that, the Company is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury of any kind including mental and/or emotional trauma caused to the Participants in any manner whatsoever, in relation to Game Play.
