JEETO DHAN DHANA DHAN - FREE TO PLAY CONTEST
CONTEST DESCRIPTION:
‘Jeeto Dhan Dhana Dhan – Free to Play’ is a skill-based contest conducted by Star India Private Limited (“STAR”) through its affiliates, partners and third parties, which can be played on JioHotstar application (hereinafter defined) for free. The PAC can be best experienced when the JioHotstar App notifications have been turned on.
DEFINITIONS:
For the purposes of the Terms and Conditions, the expressions used as shown herein-under shall have the meaning ascribed to them as shown herein-below:
“Company” means STAR and/or such of its affiliates, partners, associates, representatives, third parties or service providers as may be nominated by STAR from time to time;
“Match” means any match played as part of the Tournament solely determined by the Company;
“Winner(s)” shall mean such number of the shortlisted Participant(s) as may be selected from and amongst the Participants as determined in accordance with the Terms and Conditions, for a Match/Matches, at the sole discretion of the Company. The Winner(s) are eligible to receive the Prize(s) as stated in Clause IV (1) of these Terms and Conditions;
“JioHotstar” means the application where the PAC can be accessed. It is clarified that any other version of ‘JioHotstar’ including certain mobile, connected TV and/ or web versions may not offer the PAC;
“Participant” shall mean any person who registers and/or participates in the PAC and who (i) is above eighteen (18) years of age as on the date of participation; (ii) is a citizen of India residing in India; (iii) is of sound mind and health; (iv) is not a resident of Restricted Territory and (v) agrees to enter into and participate in the PAC in accordance with the Terms and Conditions. Employees of STAR, its affiliates, their sub-contractors and partners/ vendors in the PAC as appointed from time to time and (in some cases) members of their immediate family; persons other than Indian nationals, or Indian nationals living out of India, or those who do not qualify under the definition of resident of India as per the Income Tax Act, 1961 are ineligible to participate or win in the PAC.
“Play Along Contest” or “PAC” means the quiz contest titled “Jeeto Dhan Dhana Dhan – Free to Play” or such other title as may be chosen by Company in its sole discretion, which will be played by a Participant in accordance with the Terms and Conditions;
“Prizes” shall mean prizes of various types and categories including coupons/ vouchers as may be determined by the Company at its sole discretion from time to time and which can be changed by STAR at its discretion;
“Question” shall mean any questions that the Company may implement from time to time in the PAC;
“Stipulated Time” for the purposes of the PAC shall mean the period until which the Company permits a Participant to answer Question;
“Terms and Conditions” means these terms and conditions governing the PAC, as stated herein and as may be proactively or retrospectively amended by the Company from time to time;
“Tournament” means any game/sports tournament played between two or more teams in any part of the world as determined by the Company in its sole discretion.
PROCEDURE TO PARTICIPATE IN THE PLAY ALONG CONTEST:
Participation
The Participants may participate in the PAC by accessing it in the JioHotstar application in portrait mode. The PAC will be available for all or certain Matches as determined by STAR. By participating in the PAC, the Participant confirms the acceptance of the Terms and Conditions.
The Participants acknowledge that the schedule of the Tournament could be added to, modified or cancelled or terminated early by the relevant organiser of the Tournament and the Company has no control over it. It is clarified that the PAC shall be made available for all or some Matches of the Tournament as determined by the Company in its sole discretion.
The mobile number which the Participant provides as part of registration process will be used to identify the Participant as a unique identification number. We urge Participants to use the same mobile number used for the registration where they would be clearly identified as the Participant of the PAC. Using another person’s number to play the PAC, without their explicit permission, can be construed as grounds for disqualification.
Any entry for participation in the PAC is not transferrable.
The Participant may be required to furnish necessary supporting documentation as proof of age, address, name, photo identity, geographical location, nationality and any other metric that may be required by the Company at any time including at the time of awarding a Prize, or subsequently after disbursement of prize to the eligible Winner. Failure to do so could result in the disqualification of the Participant, including retrieval of Prize(s) provided, if any.
The Company has the right at any time to require any document, photograph and/or information to ascertain proof of identity, proof of residence and/or any other parameter related to the eligibility of Participant. The Company may, at its discretion, contact the Participant(s), if required, for any further documents, photographs and/or clarifications needed for the information and/or documents provided by the Participant and Participant will provide the requisite information.
The failure to provide relevant document and/or information as may be required by Company, through the mode and medium as prescribed by the Company, as proof or affidavit of eligibility, including the valid identity proof/ proof of name, address and correct date of birth within the time as stipulated in the Terms and Conditions or upon request by the Company may result in disqualification. The Company also reserves the right to disqualify a Participant in case where a discrepancy is found to exist in the information furnished/provided/stated by the Participant with the Company or any of the Company’s sub-contractors and partners/vendors in the PAC, and/or in the information stated in the documents furnished by the Participant or at any time and/or in the event of the Participant not providing the said information and/or document, as the case maybe, within the stipulated amount of time for any reasons whatsoever.
All personal details and information requested by and supplied to the Company by each Participant must be truthful, accurate and in no way misleading. The Company reserves the right to disqualify any Participant(s) from the PAC at its sole discretion, should the Participant(s) at any stage supply untruthful, inaccurate or misleading personal details and/or information.
The personal information being collected hereunder by the Company, shall be used solely for the purpose of verification of the Participant and for any other purpose in connection with the PAC including marketing activities and for announcement of Winner(s) as the case maybe. By participating in the PAC and/or by sharing/submitting such information to the Company, the Participant hereby consents to the use of the same by the Company for the purposes identified herein under the Terms and Conditions.
Eligibility:
Participant cannot participate in the PAC if he/she is located in the state of Andhra Pradesh and/or Nagaland and/or any other state from where you cannot participate in the PAC pursuant to applicable laws in the relevant state (“Restricted Territory”) and has chosen the same as his geographical location at the time of registration. By participating in the PAC, the Participant confirms that he/she is not located in any Restricted Territory. It is the Participant’s responsibility to ensure that he/she is not participating in the PAC from a Restricted Territory.
A Participant cannot participate in the PAC if he/she is under the age of 18 as on the date of participation.
A Participant cannot participate in the PAC if he/she is not a citizen of India and/or not residing in India.
The Company shall not issue Prizes if it learns that (i) the Participant is from Restricted Territory and/or outside India, and/or (ii) the Participant is not a citizen of India or above 18 years of age.
The Company reserves the right to request valid Government–issued identification documents including proof of age and address proof documents to verify any Participant’s eligibility for the PAC. Company reserves right not to issue Prizes, or to recover any Prize issued, if such documents have not been received within stipulated timelines and verified by the Company. Company’s determination shall be final and binding in this regard. Participants represent and warrant that documents provided by him/her are/will be true copies of the original documents.
Only those Participants whose UIDs have been registered with JioHotstar, as per their records, will be eligible for entry into the PAC, and all users are required to ensure that they have registered and have a 32 digit registration number in their profiles. In the event of anything to the contrary, the said user’s participation shall stand forfeited.
How to Play
Download JioHotstar from the iOS App store, Android Play store and/or any other store and/or website which has been authorised by the Company to enable downloads of JioHotstar and is also permitted to do so pursuant to applicable laws of India. Please note, JioHotstar download is free of cost, however data charges may apply. For further details, please contact your telecom operator and/or internet service provider.
Access the relevant match section in JioHotstar to play the PAC (below the Match feed or such other location as determined by Company). It is clarified that the PAC shall be available only in the ‘portrait’ mode and not in any other mode including ‘landscape’ mode. In the event of Participant opening JioHotstar in any other mode, he/she will have to switch the screen to ‘portrait’ mode in order to access and participate, subject to the other terms and conditions herein, in the PAC.
By participating in the PAC, the Participant confirms the acceptance of these Terms and Conditions
If the Participant wants to make themselves eligible for winning Prizes, they would be required to provide their name, phone number and any other detail as may be required by Company. These details would have to be provided through any mode and medium as required by the Company including by of an online form which the PAC will prompt them for after they have answered a PAC question or over an interactive voice response (IVR) based phone call or through text-based alerts including SMS or through electronic mails or any other mode as determined by the Company in its sole discretion, as the case may be.
The Participant may be informed about the result of his/her winning and/or eligibility to win the Prizes by means of in-app notifications, mails, calls and / or text messages sent to the Participant’s contact details entered at time of registration / subscription. The Participant is also advised to refer to active Game screen for messages pushed by JioHotstar and to check the “My Winnings” tab in JioHotstar’App’s “my space” tab for further instructions. Refer Winner Selection clause for detailed the Prize fulfilment process.
In the event the Participant uses a SIM card not registered in their name for registration, the Company will not be responsible to track such Participant.
In the event it is not possible to determine with certainty the Participant who registered from a particular mobile number, that entry would be disqualified. Participant(s) are requested to use phone numbers which are unique to them. Playing using someone else’s phone and/ or SIM card is tantamount to playing on behalf of any such other person, and if such phone number is selected as a Winner, the user of that phone number as contacted for winner determination purposes will be deemed to be the shortlisted/ winning Participant for purposes of this PAC.
Taking part in the registration process shall be deemed to be acceptance by the Participant to receive promotional messages from the Company or any third party so authorized by the Company.
The procedures for registration and participation in the PAC are subject to the Terms and Conditions stated herein. Non-conformance by any Participant(s) to the Terms and Conditions will disqualify such Participant from participation or winnings, immediately, as the case may be.
The Participant should have good knowledge and understanding of the relevant sport and conditions governing it and must also be watching/following the relevant Match in order to be able to correctly answer the Questions asked in the PAC.
Charges for the PAC
The PAC is free of cost, however data charges may apply. For further details, the Participant shall contact their telecom operator and/or internet service provider, as the case maybe.
Participant(s) to check with their respective telecom operator for any other applicable charges. In case any Participant registers while roaming in a different circle/zone/country, additional roaming rates may apply. Participant(s) to contact their respective telecom operator for the applicable rates.
Playing Rules
During any Match of the Tournament in which the PAC is live, the Participant will have to answer one or more Questions within the Stipulated Time.
Stipulated Time could vary for each question, and may be displayed on the PAC for each Question, in any manner as may be suitable; at the sole discretion of the Company.
In an on-going PAC, the Participant could lose the opportunity to play one or more Questions in any of the following scenarios:
Where a Participant answers a call / message / etc. or uses some other app on the device where he / she is playing PAC;
Device breakdown;
Where a Participant exits the JioHotstar application being used by the Participant in the course of playing the PAC;
Where there is a network drop or loss or congestion or battery drain-out in the course of playing the PAC;
Where the device (or any app on the device) on which PAC is being played hangs, shuts down, or slows down, during the course of playing the PAC;
When Participant moves to another page within JioHotstar or to the main menu of the PAC; and/or
Any other reasons including but not limited to technical, network, lag, latency, extraneous and manual errors.
Where the PAC or the ability of a Participant to play the PAC is affected by any other network / technical / phone issues, the Participant will be permitted to re-join the PAC only when the next question is asked. Further, in the event a PAC is terminated mid-session for any reasons whatsoever, the Participant will have to wait till the next question is asked during the Match and/or the Tournament, as the case maybe.
Once the answer option is selected, the Participant will not be allowed to change the answer. If the colour of the answer option does not change, the server has not received the response and the Participant would be required to select the option again. Please note that the Participant has to select the answer option within the Stipulated Time.
Post submission (selection of the option) of the answer, the Participant(s) will not be permitted to modify / alter / change the answer submitted.
Only the answers received and logged with the servers within the Stipulated Time will be considered valid. Delay in receipt of answers due to network latency or any other issues can result in that answer not being considered for the Winner determination process, and STAR, its affiliates, partners, vendors, etc. will not be responsible for the same.
The Company will not entertain any claims / questions / queries with respect to the authenticity or correctness of any Questions and answers for the Questions asked in any round of the PAC.
The Company’s decision on the correctness or incorrectness of any answer is final and binding on all Participants.
In order to be eligible for winning a Prize, the Participant must be registered and logged into JioHotstar and must have provided their geographical location related information at the time of registering. It is clarified that a Participant may still be able to play the PAC without registration but will not be eligible to be considered for the selection process for determining Winner till he/she registers himself/herself and also provides the relevant geographical location related information asked at that time.
WINNER SELECTION
1. Prize Winners
The Company may, at its discretion, decide to award Prizes as the Company deems fit and the Prize(s) so won may be announced by the Company. Prizes may be changed by the Company at its discretion proactively or retrospectively.
Participants who have previously won any prize during the tournaments running between March 2023 to May 2023, March 2024 to May 2024, July 2024 to August 2024, January 2025 to March 2025 other than discount coupons and vouchers, and Participants who won vouchers on tournaments running between September 2024 to October 2024, while participating in the PAC, are ineligible to win prizes other than the discount coupons and vouchers in this PAC for the Tournament.
Where more than one Participant have answered the PAC questions correctly, the Winner(s) will be determined with the help of randomizer software developed specifically for the purpose of selection of the Winner(s) or any other methodology as determined by the Company. The randomizer will use an appropriate method of selecting Winner(s) to break the tie or for any other reason, at the discretion of Company management. In the event of a software failure, or for any other reason, the Company may adopt any other methodology or criteria at its sole discretion to select the Winners, depending upon requirement and availability of time. The Company may, in case of selection by randomizer, select more than one Winner in any category. It is further clarified that the chances of winning a Prize are higher if the total number of questions answered correctly are higher. Hence, a Participant should try and attempt all questions to increase his/her chances of winning a Prize.
STAR will, for certain categories of Prizes, also select back-up winners, in case the selected Winner(s) cannot be contacted, get disqualified for any reason, or forfeit their Prize(s). For purposes of this PAC, back-up winners are not entitled to any prize, unless as mentioned above, a selected winner does not get his / her prize. A Participant cannot be selected as a winner and a back-up both for any Match/random draw.
Participant acknowledges that some of the Prize(s) may be awarded on the basis of their geographical locations (which could be categorised under one or more categories including: state, district, metro, block level, etc.) as determined by the drop down option selected by Participant during registration. Further, the Participant agrees that Company shall not be liable in any manner whatsoever for any disqualification, reduced change of winning, loss of Prize and/or ineligibility to participate in the PAC on account of any error, multiple and/or wrongful categorisation of the Participant(s) in one or more of the geographical categories for any reason whatsoever under any circumstances.
The Company, at its discretion, may apply certain caps on the number of prizes that can be won by any Participant for the duration of the PAC.
The Company and/or its authorized agents, affiliates and representatives will rely upon only such telephonic contact information and/or any other information as may be provided by the Winner at the time of participation in the PAC to contact him/her.
The details of the Winner(s) will be intimated by the Company to each Winner on the mobile number provided by such Eligible Participant at the time of registration or in any other manner as determined by the Company in its sole discretion.
The Company will make an attempt to get in touch with such Winner(s) (as per the applicable process for each prize). Failure to contact the Winner for any reason whatsoever (including but not limited to Participant not picking up the phone, mobile network issues, emails going to spam, messages not being responded to, Participant being busy in meetings or something else, loss of phone, participant not available where the phone is, etc.) may result in forfeiture of the Prize for such Participant and the Company may award such Prize to any other Participant and/or entirely withdraw the same at its sole discretion. Company may at its sole discretion select next eligible Participant as the Winner(s).
Where, the Winner(s) cannot be contacted telephonically or in any other manner as determined by the Company; or after being so contacted, the Winner(s) does not provide sufficient proof of identification as such Winner(s); or does not claim the Prize within specific time as informed after completing applicable formalities, the Prize for such Winner(s) stands forfeited. No further claims by the original Winner who could not be contacted or does not claim the Prize, will be entertained and the Company will not be responsible or liable in any way whatsoever to such persons.
The Company reserves the rights to determine and/ or announce and/ or change the timelines and the methodology of determining Winners from time to time.
Certain prizes may have other conditions applicable to them with respect to their redemption (as governed by the relevant commercial partners of the PAC). The Company does not guarantee or assure the completeness and accuracy of such special conditions, including any updation or revision thereof from time to time and it shall be the sole responsibility of the relevant Winner(s) to ascertain all conditions pertaining to the Prize won by such Winner directly with the relevant commercial partners of the PAC. The Company shall not be, in any manner, responsible for any decision taken by a Winner to avail any Prize and any consequences arising from the conditions that may be imposed by the relevant commercial partners of the PAC upon such Winner(s).
The Company may at its sole discretion provide for caps on Prize(s) basis any criteria including but not limited to geography, persons, age, etc.
Notwithstanding the foregoing, the Company may in its sole discretion determine the Winner(s) using any methodology including randomizer or otherwise and may also give Prize(s) at its sole discretion including for any promotional and/or marketing purposes.
Winner Declaration and Pay-out/ Prize handover
The Company reserves the right, at its discretion, to institute one or more Prizes for the PAC and the terms and conditions attendant thereto, including whether such Prizes are daily, weekly, cumulative, non-cumulative or any combination thereof. Every sub-category of Winners may not have Prizes.
The Company reserves the right to offer, withdraw or change any of the Prizes as provided herein-under, at any point of time, including after they have been announced, without any intimation to the Participant whatsoever.
The Company may, in its sole discretion, exclude a Participant from participating in any part of the PAC which may include without limitation (i) circumstances which, in the Company's view, renders the Participant unfit to participate therein; (ii) inability to produce documentation specified by the Company proving the identity of the Participant; (iii) any other reason that, at the discretion of Company, would adversely impact the Company or the PAC. At no point of time will the Company be obliged to notify unsuccessful Participants of its decision.
Company will use the mobile number provided by the Participant to identify the Winner of the Prizes won, if any. Please play from a phone that you have full access to. Inability on the part of the Participant to accordingly show or provide the required identification proof could entitle the Company to disqualify the Participant from any winnings, if declared.
Whilst the Company shall make all reasonable endeavours to (i) enable Participant(s) to proceed with participation in the PAC (ii) to contact all Winner(s) at each relevant juncture of the PAC, the Company can make no guarantee thereof and the Company shall in its sole discretion be entitled to proceed with the next entitled Participants who are eligible to be Winners under the Terms and Conditions, in case it is unable to successfully contact and communicate with Participant(s)/ Winner(s) in terms hereof.
The Company will have no liability towards a Participant who is unable to take part in the PAC and/or drops out of the PAC while playing for whatever reason and the Company shall be entitled to disqualify the Participant(s) from the PAC at any time, at the discretion of the Company.
The Company further reserves the right to replace at its discretion any Winner(s) who for any reason fails or is disqualified from or unable to participate in the PAC with another Participant who is otherwise eligible to be a Winner, notwithstanding that such Participant may have been previously eliminated from the PAC and each Participant shall agree to collect the Prizes as and when required by the Company to do so.
If at any point it is determined by the Company that any person has tampered with JioHotstar, the PAC, or any data / servers / database / etc. related to the PAC, the Company reserves the right at its discretion to revoke or cancel winnings of any such Participant, recover any Prize provided to such person, and / or initiate litigation as deemed fit and necessary by the Company.
The delivery of any Prize, including the terms and conditions applicable thereto, shall be determined by the Company and/or the relevant commercial partners of the PAC thereof, as the case maybe. Neither the Company nor the commercial partners of the PAC will be responsible should the Winner refuse to accept and/or be unavailable or incapacitated in any manner whatsoever to accept the Prize as made available.
Withholding taxes as applicable under the provisions of the Income Tax Act, 1961 on the Prize(s) won by the Winner(s) under the laws of India shall be borne by the Company and/or relevant commercial partners of the PAC in relation to the relevant Prize.
The Prize(s) to the Winner(s) shall be subject to the relevant Winner(s) providing the relevant documents (like PAN, Aadhar, etc.) as may be prescribed by the Company and/or relevant commercial partners of the PAC within stipulated time and subject to the Winner’s adherence to the applicable conditions, for the purposes of availing the Prize(s).
The Winner agrees that the delivery of his/her relevant Prize may be delayed for any reason including as a result of a delay in submission of documents, logistical issues and/ or any force majeure events and the Company shall not be liable for the same.
The Winner hereby agrees that he/ she shall not hold the Company responsible for any delays and/ or disputes and/or claims arising out of any Prize that such Winner may be entitled to, and shall indemnify the Company against any and all such claims.
The Winner hereby agrees that in case of any disputes/ claims arising out of any Prize, the same shall be addressed directly with the relevant commercial partners of the PAC of such Prize and the Company shall not be held responsible for the same.
The Company may refuse to pay winnings, award the Prize(s) or reclaim all sums paid to Winners in the event of any fraud, dishonesty, ineligibility or non-entitlement on the part of any of such Winner(s) to participate in the PAC under the Terms and Conditions.
In the event a Winner who is selected for any Prize (including but not limited to smartphone, travel vouchers, or any other prize, as the case maybe) does not, or for any reason cannot, claim or take possession of such Prize, or is disqualified, Company shall have the right to deal with such unclaimed Prize in any manner it deems fit including, but not limited to, forfeiture, selection of a replacement Winner, return of prize, re-distribution to another content or draw, etc. Company shall not be responsible for any defects, mechanical failure, electrical failure and/ or any other reason as a result of which the Winner(s) is unable to enjoy the Prize and the Company shall have no liability whatsoever in any manner to the said Winner(s).
The Winner(s) acknowledge that the Prize(s) are non-transferable / saleable.
Valid user IDs are those available with Company in its database and are not guest IDs, and shall be those as determined by Company at its discretion. Other IDs from which the PAC has been played may be removed from list of Winner(s) at the sole discretion of Company.
Promotional Activities
The Company may, at its sole discretion, promote any products and/ or services of its commercial partners of the PAC or third parties during the PAC (“Promotional Activities”). For such Promotional Activities, the Company may provide any Participant with any goods and/ or services and/or merchandise (“Promotional Materials”).
The Promotional Materials may be provided by the Company at any time during the PAC.
The Participant agrees that any footage or any photographs of any nature of the Promotional Activities shall vest with the Company, including but not limited to all intellectual property rights and any other rights for worldwide use and in perpetuity.
The Participants who are provided with the Promotional Materials agree that they shall co-operate with the Company and participate in any activity and/or campaign of any nature whatsoever without any money payable to such Participants.
By participating in the PAC, it is construed that the Participant has accepted providing his/ her contact details on the PAC and the consent to allow the Company to use the contact details for its marketing activities, any other use, and/ or transfer the same to any third party/agencies to collect, maintain and share the same solely for the purpose of use in connection with the PAC or any other allied activity such as marketing solely in connection to the PAC or as instructed by the Company.
RESPONSIBLE GAMING
The Company cares for its Participants. The Company tries to protect the Participants who are at risk of potential negative effects of online gaming through a number of means. Most people play online for fun and entertainment, but we recognize that a small percentage of people will attempt to play when they’re underage or allow playing online to control them and affect their lives.
It is illegal for anyone under 18 to participate in PAC. PAC is open for Participants over 18 years of age. We take declaration from users that they are over 18 years of age. We reserve the right to ask for additional age verification information from the user and suspend the user’s account until he/she provides information that verifies appropriate age to our satisfaction. If a user is found to be underage, that user’s account will be terminated. Other legal ramifications may also apply.
The Company believes in providing a platform for entertainment and not a platform for making monies. In order to ensure this vision reaches the Participants, the Company does not take real-money or award winners with real money at any time for participating in PAC.
Responsible gaming means making sure parents understand the importance of supervising their children’s online activities. The internet is readily accessible in many homes in India. As a result, we would like for us and parents to work together to protect children from playing underage fantasy sport.
Tips for parents:
Do not leave children unattended near your mobile phone when you are playing the PAC.
Do not allow under aged children to participate in any Daily Fantasy Sports activity.
If the user is worried about spending a lot of time on PAC then he/ she can self-exclude himself/ herself from our website/mobile application.

SYSTEMS AND AVAILABILITY
The Company will not be responsible for any break or disconnection or disruption in network connectivity in any manner, due to network congestion or signal loss or any other technical reasons, irrespective of the network being used. Network issues can disrupt various aspects of the PAC such as receipt of questions and answer options, submission of answers, receipt of any sound, text, image or audio files related to the question, receipt of answer chosen by the Participant, etc. The Participant is advised to remain in an area with a strong and stable/ continuous mobile network signal of the telecom operator or internet service provider to ensure smooth functioning of the PAC.
Any loss or outrage or dissatisfaction suffered during the course of playing the PAC by a Participant would not be the responsibility of the Company and the Company will not be responsible to make good any such loss or dissatisfaction.
All attempts will be made to protect the data from loss and corruption, but in the event such data loss happens, Company may have to continue with whatever data is available, or in any other manner as it may deem reasonable. The Company should not be held responsible for any loss of data or the action taken on account of the same. The Company will not be held responsible to make good any such loss or dissatisfaction on account of such loss.
In the event the response of the Participant is not received for any reason within the Stipulated Time period for the question, such Participant’s response would not be considered irrespective that question(s) was correctly answered by the Participant. The Participant can continue to answer Questions once re-connected to the central PAC contest server(s). Company or its vendors and partners are not responsible for any such instances.
In case multiple answers are received from a Participant for the same question, Company has the right to choose any one answer entry received from that Participant. If multiple entries are received at the same time, then the Company will chose any of the answer entries received.
Prior to start of play of the PAC, the Participant must check that JioHotstar is updated, operational and functioning correctly. The Participant is advised to keep adequate RAM and phone memory available to ensure smooth functioning of the PAC. Closing other applications on the device will also help towards smoother gameplay in case of some phones.
Participant is advised to keep the device from which the PAC is played, adequately charged. Low battery will result in shut down of the network and/ or device and that will result in the Participant not being in a position to play along with the Match.
The server used to communicate with the Participant has adequate redundancies built into it. However, in rare cases, if the server is down during the PAC, the Company will, at its discretion but not as an obligation, determine such measures as it may deem fit, including cancelling certain questions, sections or segments or any other means at the discretion of the Company.
The PAC is heavily dependent on satellites, networks, receivers, connectivity, cloud issues and various forms of latency due to which there could be technical issues including lags, latency and/or alignment. These would be outside the control of the Company and the Company will not be responsible for any consequences or liability arising therefrom, to any part whatsoever.
All Participants need to adjust the device display, font and resolution to default size or lower to ensure that they are able to play the PAC on their devices properly. If not, then the “Play” and answer options might not appear on the device screen during gameplay. In case the Participant is not able to play the PAC on account of this, the Company will not be responsible in any manner whatsoever.
The Participant acknowledges that all possible issues may not have been identified by the Company and its partners, and agrees to hold harmless the Company and its partners for the application, network, process, technical or any other failures. Any losses, injury, discomfort, loss of privacy, inability to participate or any other discomfort of any sort caused to the Participant or the Participant’s property or device shall not be the responsibility of the Company or its partners.
No person (i.e., either the Participant, or any person on behalf of the Participant) shall initiate litigation against the Company or its partners in any manner without first providing the Company a report/complaint through the ‘Help & Legal’ section within JioHotstar and providing the Company an opportunity to address the complaint.
In case any unauthorized activity is observed on the PAC, that particular Participant will be disqualified to play till such time as the Company deems fit. The Company would not be responsible in any manner whatsoever on account of such disqualification.
Company shall not be liable for any failure of the application server or system in the course of playing the PAC.
The Company shall endeavour to make all reasonably practicable arrangements but it cannot guarantee or assure seamless connectivity or continuous availability of JioHotstar, server, system or software to the Participants during the conduct of the PAC as these are dependent on external utilities/ service providers and factors which could be beyond control of the Company.
Company, its authorized personnel and its sub-contractors are not responsible for delayed receipt or non-receipt or incomplete receipt or corrupt receipt of answers.
The Company accepts no liability and shall not be responsible and/or liable in any manner whatsoever in case the Participant(s) are unable to participate in the PAC due to failure on the part of the telecom operator, facility provider, internet service provider, login service provider, etc., or due to capacity constraints.
Participant acknowledges that the PAC shall only be available on the mobile/ smartphone application of JioHotstar. It is clarified that the PAC shall be available only in the ‘portrait’ mode and not in any other mode including ‘landscape’ mode. In the event of Participant opening JioHotstar in any other mode, he/ she will have to switch the screen to ‘portrait’ mode in order to access and participate, subject to the other terms and conditions herein, in the PAC. It is clarified that any other versions of ‘JioHotstar’ including mobile and web versions may not offer the PAC and the Company is not bound to provide the PAC on such other versions under any circumstances.
It shall not be open for the Participant(s) or any of their representatives to require an audit or verification of answers, randomizer/ selection software or any other criteria, process or system adopted by the Company as part of the process of conduct of the PAC or selection of Winners resulting therefrom. No enquiries, appeals, verbal or written, shall be entertained in this regard.
EXPENSES & LOGISTICS
All costs in relation to availing the Prize and/or the benefits thereof including but not limited to any travel and accommodation costs, etc. to avail the Prize(s) shall be borne solely by the selected Winners and the Company or its sub-contractors/partners shall not be liable for the same.
CONFIDENTIALITY AND PUBLICITY
The Company shall keep all the information collected from the Participants confidential and shall not share the information so collected with any party (save and except its process validators, auditors or employees or personnel on a need-to-know basis), save and except for the purpose of the present PAC. The Participant by providing the aforesaid personal information hereby agrees that the Company shall have the right to share the information so collected with such other third party as required for the purpose of the PAC and hereby consents to the same and further agrees that the Participant shall not file any claim against the Company for sharing of such personal information. Any information shared by the Participant to the Company shall be handled by the Company in accordance with the terms of the Privacy Policy of the Company available at: https://www.hotstar.com/privacy-policy/in.
Notwithstanding anything under these Terms and Conditions, by participating in the PAC, it is construed that the Participant has accepted providing contact details on the PAC and the consent to allow the Company to use the contact details for its marketing activities, any other use, and/ or transfer the same to any third party/agencies to collect, maintain and share the same solely for the purpose of use in connection with the PAC or any other allied activity such as marketing solely in connection to the PAC or as instructed by the Company.
None of the Participants shall, without the prior written approval of the Company, speak to the press or any other media or any third person, nor give any interviews or comments relating to any aspect of the PAC, nor post any non-public information on any social media platform. The Participant shall not disclose any information whatsoever relating to the Company to any other party. Violation of this clause shall immediately disqualify the Participant’s prospects of further participation.
The Participant shall at all times keep confidential all particulars and details regarding the PAC.
The Winner(s) of the PAC as announced by the Company from time to time, agrees that he/ she shall make himself/ herself available at time and location as asked for by the Company and co-operate with the Company and participate in any activity and/ or campaign of any nature whatsoever without any money payable to the Winner(s). Further, the Winner(s)/ Participant(s) shall at no point of time refuse or disagree to participate in any such campaign or activities for any reason whatsoever if required by the Company. The Winner(s)/Participant(s) agrees that the footage of any nature shall vest with the Company, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity. Any failure to comply or improper compliance with the foregoing shall result in the forfeiture of the Prize and the Company shall not be liable for the same under any circumstances.
Any photographs, videos etc. submitted by the Participants/ Winners to the Company or recorded, shall on submission/ creation become the property of the Company and shall be available to the Company for exploitation throughout the world in perpetuity. The Participant(s) shall ensure that the photos or videos submitted by them in any public domain or their performances shall not be obscene, vulgar, defaming, denigrating women or children, hurting religious sentiments, depicting violence or shall not infringe the rights of a third person and/or entity. The Participant(s) shall solely remain liable for any action (criminal/ civil) arising therefrom. It is further clarified that in the event the Participant fails to provide his photograph, video, etc. as requested for by the Company, the Company shall the right to use the photograph of the Participant from the other documents submitted by him/ her for the purposes of this clause.
Acceptance of these Terms and Conditions by the Participant constitutes permission for the Company, including its affiliates, service providers and partners, to use and/ or click photographs, use and/ or record videos of the Participant(s) and use the Participant(s) name, photographs, likeness, voice, comments, mobile numbers (partially hidden) and geographical location for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any additional compensation whatsoever.
INTELLECTUAL PROPERTY
The Intellectual Property rights ("Intellectual Property Rights") in JioHotstar App, underlying Company and the Company Platform, and material published on JioHotstar App, including (but not limited to) games, contests, software, advertisements, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings and flash animation, is owned by the Company, its partners, licensors and/or its affiliates and associates. Participants may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on the Company either in whole or in part without express written license from Company.
USER CONDUCT
Participant(s) agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of any computer or server used to offer or support the Company or the Company services, and/or the PAC.
Participant(s) shall not attempt to gain unauthorized access to the user accounts, servers or networks connected to Company services by any means other than the user interface provided by Company, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that underlies or is part of the Company services.
Participant(s) shall not attempt to transmit content regarding services, products, surveys, contests, pyramid schemes, spam, unsolicited advertising or promotional materials, or chain letters.
GENERAL TERMS AND CONDITIONS
This PAC/contest and scorecard is based on facts available in the public domain.
The Company and/or the PAC are not in any way associated with or sponsors of the relevant Tournament. All advertisements and branding that are visible on the PAC have been provided by and/or are related to the commercial partners of the PAC and/or the Company and are not in any way associated with or official partners of the relevant Tournament.
The participation in the PAC(s) shall be considered to be acceptance of these Terms and Conditions and that the Participant has read and understood the Terms and Conditions with respect to the PAC.
Any gratifications being redeemed by the Winners through third party platforms shall be subject to the terms and conditions of the said third-party platforms. The Company shall in no manner be responsible for any failure on the part of such third-party gateways to gratify the declared winners. The Participant hereby undertakes that he/ she shall not raise any claims against the Company in this regard and shall keep the Company indemnified to that extent.
The Participant hereby represents that he/ she is not under any exclusive contracts with any other third party/ agency or is not under any kind of disqualification under law to enter into an agreement with the Company, as the case may be.
The Participant undertakes, warrants and guarantees to the Company that the Participant has the full legal capacity to participate in the PAC in accordance with these Terms and Conditions.
The Participant acknowledges that he/ she has voluntarily chosen to participate in the PAC at his/ her free-will and is willing to bear all risk, costs and consequences arising from such participation in the PAC.
The Participant shall not have any claim against the Company and/ or any of its affiliates connected with the PAC for the same. The Company or any of the affiliates, vendors or partners connected with the PAC shall not be responsible for any such eventuality and the Participant(s) shall not be entitled to claim any compensation from the Company.
In the event of any fault, misunderstanding or dispute concerning any part of the PAC, and/ or the operation of the telephone system, the selection of Winner at any stage, the validity of any question or answer options, the call-back verification process, etc. the decision of the Company shall be final and binding on all Participant(s) and other persons. The Company is empowered to take a decision on any case or instances not covered by the present Terms and Conditions.
The Company reserves the right to amend (add, delete or modify) the Terms and Conditions prospectively or retrospectively, at its discretion and without prior notice, in order to improve the PAC or remedy any issues that occur or for any other reason as the Company may deem fit without any intimation to the Participant whatsoever. It is the responsibility of the Participant to keep itself updated with the Terms & Conditions and amendments thereof from time to time.
The Company has the right at any time to terminate the PAC without any prior intimation or notice to the public and also the Company is not obligated in any manner whatsoever to compensate any person or persons who have participated in the PAC.
Registration or participation in the PAC does not guarantee a Prize or award.
If the operation of the PAC; the organisation of any/ all of the Matches/ Tournament is prevented by an event of force majeure or otherwise, the Company may cancel all or any part of the PAC, or take such other decision as it deems fit.
In case the Winner(s) is found to be in violation of any and all rules/ process of the PAC, the Company reserves the right to initiate legal proceedings against such person(s) including but not limited to having the concerned Winner to refund the Prize together with penalty interest as deemed fit by the Company. If at any time, including after disbursement of Prize, any information submitted by the Participant(s) is found to be incorrect, false, or otherwise misrepresented or misleading, the Participant(s) shall be liable to refund all amounts received from the Company and the Company shall have the right to reclaim the Prizes from the Participant(s).
The Participant acknowledges and agrees that he/ she may receive certain notifications relating to the PAC on their device. At any given point of time, if the Participant decides to not receive notification, he/ she may turn off such notifications through settings tab of the app.
If any provision of these Terms and Conditions is held by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these Terms and Conditions and the remainder of the affected provisions shall continue to be valid.
The Company accepts no liability and shall not be responsible and/ or liable in any manner whatsoever in case the Participant(s) are unable to participate in the Game due to failure on the part of the telecom operator, internet service provider, facility provider, etc., or due to capacity or other constraints.
These Terms and Conditions and the PAC shall be governed by and construed in accordance with the laws of India and the Participant(s) submit irrevocably to the exclusive jurisdiction of the Courts in Mumbai.
The Company is empowered to take a decision on any case not covered by the present Terms and Conditions, which shall be binding on all Participants.
In the event, a Participant’s location details captured during the course of the PAC indicates that he/ she is residing in Restricted Territory and/ or does not match the actual location of the Participant that is provided during the verification process or as part of any document submitted by the Participant then such a Participant will be declared ineligible to win any prizes as a part of the PAC.
The Company is in no manner whatsoever responsible and/ or shall not be held liable in any manner whatsoever, for any losses, physical injury, death, mental trauma caused to any Participant(s) and/ or the Winner(s) in any manner whatsoever, in relation to their participation or attempt to participate in the PAC and/ or related to their enjoyment or process of receiving of any Prize. Further, the Participant acknowledges and agrees that the Company shall not be liable for any and all claims for any losses, claims, damages, liabilities, judgments, fines, obligations, expenses and/ or liabilities of any kind or nature whatsoever (including but not limited to civil or criminal) arising out of or related to, whether directly or indirectly, in any manner whatsoever, in relation to the PAC and/ or the Prize (including but not limited to any defects, mechanical failure, etc.) and/or otherwise. Participant also acknowledges and agrees that Company shall not be liable for any loss of profits, indirect losses, incidental, special and/ or consequential damages arising out of or in connection with the PAC, Prize and/ or otherwise. Notwithstanding anything contained to the contrary, the total liability of the Company shall not exceed Rs. 100/- (Indian Rupees One Hundred only).
The Participant shall not at any point in time, directly or indirectly, make any remarks or statements or indulge in activity that would cause disrepute, disparagement or defamation to Company, the PAC, the Tournament or any director, employee of Company and/or the employee/representative of the Tournament organizer or any office-bearer/employee/representative of any sports federation or sports confederation.
The Winner(s) and/or the Participant(s) of the PAC agrees that he/ she shall hold harmless the Company, its directors, employees, officers, sub-contractors or any other person in connection with the Prize won by him/her and/or in relation to the PAC including but not limited to the procedure in the PAC and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against commercial partners of the PAC and/or the Company to claim any damages or reliefs.
The Company and/ or any of its affiliates shall not be liable for any loss of earnings, employment or otherwise caused to the Participant(s) and arising as a result of his/her participation in the PAC.
The Company and/ or any of its affiliates shall not be liable for any content provided by third party partners on the PAC.
The Participant(s) hereby agree to indemnify the Company and its affiliates against any claims that might arise from their actions or omissions while participating in the PAC.
The only way to enter PAC is through participation as described in Terms and Conditions. There is no other way of entering the PAC. Any person claiming that he/ she can help get you wins for a consideration and asking for your sensitive details like bank account details, password, etc. is defrauding you. Please do not share the same with them and contact your local police and report this person immediately. For the avoidance of doubt, it is clarified that under no circumstances will any person be asked to pay any amount in any manner to get a prize won by him/ her, or provide bank account details, passwords, PINs etc.
In case of any queries, the Participants may write to hello@jiohotstar.com setting out your concerns/issues related to the PAC. All endeavours shall be made to reply to the queries within reasonable time on a best effort basis. However, the absence of a reply shall not be deemed to mean acceptance by the Company of any claims made in the query.
